Man suing the first responders who rescued him

This happened just a few miles from me.
Incidentally, in CO a first responder is protected from lawsuits only if he is a volunteer.

I think his argument (through his lawyer) is that they "overlooked" him; that they didn't do enough to assess whether or not the vehicle was occupied by a living person.

As a EMS responder, I can dig the idea that they had a moral duty to act: that is, to do whatever they could to determine whether or not the vehicle was occupied. That said, there's painfully little detail about the particulars of the accident and the resources on scene to determine whether or not they had an ability to act. How deep/clear was the water? Could they actually see the vehicle? Was a SCUBA rescue team on call that could have been dispatched? "First responders" would almost surely NOT be trained in water rescue; I know I'm not and wouldn't be foolish enough to try to freelance it by diving (pun intended) an unknown water rescue without the proper gear and training. Where the "first responders" may end up on the cross is for not requesting appropriate additional resources.

Ain't that a bitch? Damned if you do... damned if you don't. We live in a 'get rich quick' thinking, lottery society and this guy is going to 'cash-in'. SOB should be thankful someone did something to save his sorry ass and he's still breathing. Disgusting!!
