I would hope that an incident as described happens to someone who has deep enough pockets to litigate the matter.

The entire business of employers being able to drug test employees is constitutionally wrong. An employer rents your services for part of the time. Employers have no business trying to regulate what one does on one's own time. The worst part about "drug testing" is that the results are bullshit. The bad stuff, like heroin, barbiturates, cocaine, etc, all metabolize out of your system in about 48 hours. The least harmful drug, marijuana, has metabolites that show up for weeks after the ingestion. In no way does the effect of the drug match the test results.

If drug tests are acceptable, why aren't ALL employees subject to them, including all management, right up to the corporate officers? The employees should be able to select which management is tested.

Slavery is supposed to be illegal. How is allowing employers to control what you do on your own time any different than slavery?

Back in the day, we were never tested on the railroad. Hell, as soon as the hand brake was set, it was doobie time. Unfortunately they make you piss for any reason they can think of. Usually the crap comes down from the worst drunks on the rails. I much rather work with a guy who smokes after work than someone who drinks all night.

Agreed.
And as long as drug-testing exempts the two drugs which cause:
- The most death and disease: tobacco.
- The most aggressive behaviour and dangerous driving: alcohol.
...then the whole premise for doing it is a farce.

while I would agree on philosophy, current law does not. The deep pockets would be emptied.

IMHO - do whatever you like on your own time.

but if your behavior affects the workplace performance or other employees' performance,,.....

Employment should be about performance.

Publicly visible employees (entertainment, politics, sport figures, etc) - we might extend the (private) contract to personal life as well. But then the contract should be specific and signed. But that's because 'performance' includes public persona.

(I think this extends even past showing up high or drunk, even to people that stink so bad from cigarette smoke that other employees can't work around them.)

Then, legalize it all, tax it. AND SERIOUSLY punish abuse of it. And leave alone any that are responsible about it.

(IMHO - it's whiny to discuss why liquor is so much more worse or not - we need to just have a standard that applies to both and stick to it)

I have to disagree with you. I spent over a decade working for AT&T where I had to be able to pass a drug test. Their company, their rules.

When they legalized medical marijuana over here in 2008 I quit and opened an indoor gardening store and we wouldn't hire anyone who couldn't test positive for marijuana. My company, my rules.

Big brother should have no say in it. Don't like the rules? Don't work there.

I've been telling the old lady (she doesn't smoke) if Missouri ever legalize I am off the rails and setting up to grow legally. My lights have been cold for too many years. When I did grow, I worried about getting nutrients. The Worms Way in St.Louis always had cops sitting in their parking lot. Kinda made ya nervous. Even ordering online made me somewhat nervous. Would love to open a grow store in Southwest Missouri if the State ever allows legal mj.
