Not only can the property owner have you arrested but the state has jurisdiction also. From the looks of things in this video, if this cop chose to be a racist then it appears he could act out his racist desires all day long. He was wanting to see if there wasn't something else ( alcohol ) mixed into that can. Maybe in this case there wasn't... Loitering could be a major problem ( would it surprise you) and he's coming out to break it up before it ever gets started. What makes you say the store is ran by the state? The information on the video says "ABC Liquor Store"...The state runs the liquor stores in North Carolina? To your point about the large number of black people he could take his racism out on.....they didn't piss him off. Maybe hes not a racist, but I am pretty sure he wouldn't come grab the iced tea out of my moms hand when shes standing outside talking to her friends. Yes, in N.C. plus 16 other states, in one form or another. The "ABC" stands for Alcoholic Beverage Control. http://en.wikipedia.org/wiki/Alcoholic_beverage_control_state#State_listing
Bignugget 0 #53 May 5, 2013 Very interesting. I imagine it wouldn't be hard to get the state to back the cop up in that case.
Kennedy 0 #54 May 5, 2013 QuoteQuoteQuotecan police independently determine trespassing without the property/business owner saying the person is in fact unwelcome? From a probable cause standpoint (i.e., right then and there at the scene), you have to take it on a case by case basis. The officer looks at the totality of the specific circumstances. Something like a posted no-trespass sign would be one example that would seem to fill the bill. (There could be lots of other examples, too, but I'm trying to be concise.) But that's only at the arrest phase. Then the state has to make the charges stick in court. In most states, in order for trespass charges to stick in court, the premises owner (or occupying tenant) has to testify to the defendant's non-permission to be or remain there. That's it in simplified form. Thanks, always best to keep it simple for a guy with a My Little Pony avatar. Every ABc store in NC is state owned and has signs posted for no loitering, trespassing, consuming on property, etc.witty subliminal message Guard your honor, let your reputation fall where it will, and outlast the bastards. 1*
Bignugget 0 #55 May 5, 2013 Yea I see that. Very interesting. How does it work? Are they state employees? They get benefits that state workers get? That would seem like the best liquor store job ever if so. In my neighborhood I am pretty sure none of the liquor store employees would qualify to work for the State, and I would wager there are no full-time benefits. I had no idea the state runs liquor stores. Learn something new every day.
Kennedy 0 #56 May 5, 2013 Overall Summary http://reports.abc.nc.gov/uploads/resources/43e805f02a254abd85cbc23135b17e97.pdf ABC faqs http://abc.nc.gov/faq/category.aspx To clarify, each store is not directly run by the state, but is run by county ABC boards that must comply with all the numerous and expansive ABC laws and regulations. And yes, there's a lot of competition for store jobs, and it's just one more way bC has too many employees going jobs that would be better left to the private sector.witty subliminal message Guard your honor, let your reputation fall where it will, and outlast the bastards. 1*

Like I said, ALE is trained in the state highway patrol academy along side troopers. Loitering in an ABC parking lot is legally trespassing, and if you've met troopers anywhere you know their view of even the slightest of violators. I'll leave you to infer what attitude is most likely of anyone hanging out.witty subliminal message Guard your honor, let your reputation fall where it will, and outlast the bastards. 1*
