Fox Television Stations, Inc." http://www.supremecourt.gov/opinions/11pdf/10-1293f3e5.pdf Well, it turns out that the FCC fines were thrown out because "The fundamental principle that laws regulating persons or entities must give fair notice of what conduct is required or proscribed," (This, of course, is the whole reason why I stand against the whole "living, breathing Constitution" argument. "Living, breathing Constitution" is a nicer sounding name for "we think it should say this and that everybody should have known we would say it should say this," which is another word for "arbitrary.")
