In this case, a craven management with a "zero tolerance" plocy was forced to back down by a union, with the full support of a properly outraged public. According to RWCs, management should be able to whatever they want, and the employees should shut up and take whatever is dished out, or leave. Of course, when it happens to them or theirs, their tune changes quickly. No problem if it happens to "others" that aren't like them. Money rules all, by their measure. Begin quoted text >>> A Safeway clerk in Northern California who was suspended from his job but applauded as a local hero after he struck a man who had been kicking his pregnant girlfriend was reinstated with back pay by the supermarket chain Wednesday. United Food and Commercial Workers Local 5 President Ron Lind said Safeway managers agreed to let meat clerk Ryan Young go back to work at the company's store in Del Rey Oaks, Calif., following a monthlong suspension. The union had filed a grievance on behalf of Young, who also was commended by the Del Ray Oaks' police chief and cheered by Safeway customers from California and beyond for stepping in to defend the pregnant customer on April 21. Some Monterey County residents boycotted and picketed the store where Young was employed. Until Tuesday, Safeway had defended its decision, saying that Young was suspended for unspecified actions caught on a store surveillance video during the confrontation. Lind said the move was an automatic response based on the company's zero-tolerance policy on workplace violence. "While Safeway has legitimate policies and concerns around workplace violence and the appropriate employee response, once the company heard our presentation of the case including Ryan's explanation of the incident, management realized that the suspension was not appropriate and immediately worked with us to resolve the grievance and put Ryan back to work," he said. Young released a statement Wednesday through the online social advocacy organization Change.org, which sponsored a petition signed by 180,000 people expressing outrage at Safeway's actions. "Knowing that I had all these people standing behind me and that I wasn't alone really helped me through this difficult time," he said. "I'll be returning to work soon and I'm ready to move forward." Safeway did not immediately respond to a request for comment. According to the statement he gave police, Young was working behind the meat counter when he saw the pregnant woman and her boyfriend arguing. He leaped to her defense when the man got physical with her. The man, Quyen Van Tran, was sentenced to three years' probation and ordered to attend a 52-week domestic violence class after he pleaded no contest to misdemeanor battery on Friday, according to the Monterey Herald. muff528 3 #4 May 23, 2012 By his action (and his violation of Safeway's "zero-tolerance policy on workplace violence") that meat cutter, as a representative of the company, potentially exposed Safeway to million$ in losses if he, that girl, the baby, the boyfriend or some other person happened to be "seriously" injured or worse during the altercation. Would his union have also filed a grievance if he had been injured and could not work after violating company policy? I'd bet they would, claiming that the company failed to provide a safe workplace or some such BS. Besides it looks more like market forces (180,000 signatures) and not union enforcers got him his job back. Of course the union takes the credit. I agree ...the suspension was not the appropriate response. They should have sent him packing. They should have canned him. (sometimes I crack myself up ) My opinion, of course. Not only is it intellectually dishonest, it avoids solving the problems because they never get addressed. When you are ready to have an intellectually honest discussion about the pros AND cons of unions, let the rest of us know. While I don't think that the union had everything to do with this case, I think they helped (public outrage did the rest). This is what unions are supposed to do.
