This guy should get a pass or charge dropped...

Although he fired his gun into the ground to stop a burglar, would he have been better off yelling "stop or I shoot!"?

Shame the rest of the United States isn't like Texas... [:/]

I think he should be given a citizen's award.

Had he shot the man center mass and killed him
Claimed he felt threatened it would not have even made the news

Something to consider

I dunno, this is in the liberal bastion of New England. He may be screwed.

New Hampshire places a very high value on personal freedoms (it's considered to be the #1 personal freedoms state by some groups). I've had a burglar stopped by a shotgun-wielding neighbor (who didn't have to fire it), and I appreciated it.

Let's see how it plays out in the courts, but I'll bet that the eventual sentences are not hte same.

There is nothing more dangerous than breaking a basic safety rule and getting away with it. It removes fear of the consequences and builds false confidence. (tbrown)

So much for being a good neighbor! I was taught, that if, you pull a pistol, you don't fire a warning shot. You aim for his middle. I hope, this guy gets the charges dropped. I wouldn't be surprised if the bad guy didn't turn around and sue the guy for holding him till police arrived.
