lawrocket 3 #1 January 24, 2012 Take a look at the lengths to which groups are going to get judges kicked off the Supreme Court panel for the Affordable Care Act. What is most disheartening is the absolute lack of any degree of intellectual integrity on either side of the aisle. On the one side, you’ve got the left (including a number of Democrats in the House of Representatives) who are trying to get Clarence Thomas to recuse himself because his wife is affiliated with a Tea Bagger group – that the mere appearance of impropriety is enough. That h And then you’ve got the other side. Members of the right are trying to get Elena Kagan ousted because she was Solicitor General. (In fairness, Orrin Hatch suggested that she recuse herself before the House Democrats wrote the letter to Thomas). The reason is that she was President Obama’s Solicitor General when this Act was being drafted and passed – something I find to be a load of baloney. And now there is publicity hound Larry Klayman pushing hard to get her kicked off of the panel. It’s why I find politics to be so disgusting when it comes to court matters. I haven’t found anything in the judicial ethics that commands recusal. It’s not about judicial ethics – it’s about politics. Plain and simple. It’s why Klayman isn’t seeking to get Thomas kicked off. John Roberts should be applauded for his stance that he took. And I’ll put it this way – let’s say someone challenges your professional integrity in this way. What would your response be? These are political beasts using political weapons against an apolitical organization. I find it disgusting. Let Kagan and Thomas stay. Leave them alone and let them do their jobs. And let’s not commence with a ritual where politics decides who hears a case and who does not. Selecting justices to hear a particular case due to political motivations is as bad as it sounds.
