JR, I realize you don't want to acknowledge it and that's fine by me, but when somebody calls you an "old fat red man" or anything equally egregious, I actually do do my best to deal with it fairly.

The issue is, and I know this goes past a lot of people, none of the moderators are actually on-line 24/7 and sometimes folks have feuds that go on for hours before any of us even have a chance to see them.

It may look like we're not personally addressing your issue, but the fact is, it may be that nobody is actually watching at the moment or the topic the feud is in just isn't all that interesting to us and we don't read every single message in it looking for every minor thing that may offend every single person.

Take a step back from the screen every once in awhile and gain some perspective. Not everybody that doesn't share your point of view is out to get you.

Personally I am not a big fan of open carry. I don't draw attention when I am carrying my handgun. I don't scare little old ladies, and I have the element of suprise if I even needed it. I also have way less risk of some one grabbing my gun.



open carry in California is a protest act, with the intent of getting viable CCW permit access. As it stands, the local county Sheriff must approve any requests and for most counties, that means no permits unless you're politically connected. San Francisco has roughly 10 such permits.

Is it an effective protest? Probably not, but as others suggest, that's the typical reaction when people try to assert rights that others don't approve of.

That was John's point. You called him an old fat red man, get about the softest of warnings possible, and respond - sorry, maybe he's not old, just fat and red.

Nice work by the cop. I'm guessing that their department is aware of all the negative publicity from the (multiple) incidents involving citizens videoing cops. And have probably developed a policy about it.

That cop was calm, cool and in control. Very professional. Far, far different from the one in Ohio.

And the guy with the gun was obviously trolling for an confrontation like that. With the camera and no ID on him, he was pushing buttons. Legally and within his rights, but clearly pushing. I'll give him credit. Risking the possible consequences in order to exercise his rights. Just like the civil rights protestors in the 60s.

Last thing - although he was not violating any laws videoing the incident, recording audio of it is a different matter. California is a "Two Party Consent" state. Both parties in the conversation have to consent (or at least be made aware) to the recording.
The cop could have politely pointed that out to the dude.

Something along the lines of "I'm not going to cite you for it, but you might want to check Califronia's laws on audio recording. While the video camera is legal, recording the audio without my consent isn't."

Not really. They were having what could be classed as a "private conversation" even though it was out on the street. It has the same protections as a phone conversation. The link below talks about the "reasonable expectation of privacy" even if it's out on a public street.

There was a motorcyclist who got arrested for this for recording the cop with his helmet-mounted camera (GoPro?) under the same sort of law.
The charges were later dropped IIRC, not sure under what circumstances, but the law is still there.

One day on a PGR mission, I discussed the open carry proposal for FL with a deputy sheriff. He was not in favor of open carry. He considered it advertising. He stated that in our area if the gang bangers know you have a gun they will take it away from you.

He emphasized that with, "Don't think for a minute they won't."

If you are going to carry, have a CCP and keep your weapon hidden, until needed.

BTW, the open carry law did not pass in FL.

However, you've instead decided to take umbrage at her giving you an apology and assume the worst. I'm sorry to see that.

She may have meant it as an insult, she may have not. It's subtextual, so we can, in fact, only guess.

If YOU choose to see the worst in everything, then indeed everyone and everything does, I suppose, seem to be against you.

I gotta be honest, I have NO idea what she meant by "old fat red man." I think maybe we can both agree that "man" isn't exactly an insult. "Old" she explained, which only leaves the "fat" and "red" adjectives. I have no idea what your weight is, but let's assume that's a relative issue and still almost certainly an insult. Ok, maybe she needs to explain that one too.

"Red"? I can't even fathom what the insult is there. Seriously. Is there something I don't know about you? Are you a native American? If so, yes, that is an egregious insult and I absolutely will deal with it according to the forum rules. But seriously, are you? I don't recall the topic ever having come up before.

On the other hand, if you're NOT a native American, I can't for the life of me figure out why you'd be insulted by that.
