Moving across country, need to take my firearms with me

I'm moving from Virginia to Arizona next week. I have two rifles and one pistol to transport, and while the moving companies seem to be OK with transporting unloaded guns, they're not a fan of moving ammunition and I thought I might just take guns and all with me in my car rather than worry my wife and the movers with them.

Will I be OK transporting unloaded guns across state lines, with unloaded firearms in the trunk and ammunition in the passenger compartment with me? Would it help to disassemble the firearms?

Anybody know of any resources I could check online to determine if there are particular state laws I need to be aware of? I'm travelling through VA, TN, AK, TX, NM, and AZ.

Just to stress, this is NOT about carrying concealed. I just want to get the firearms and ammunition from point A (Virginia) to point B (Arizona) without ending up in point C (the pokey).

I used to suggest folks transport themselves following federal law (unloaded, locked container, not accessible, etc) but ever since this incident I just tell folks to be careful and make their own decision. If you've got spare time and cash, you can consider having an FFL in your area ship it to an FFL in your destination area. That way they get there without you having to transport them, and without having to trusty them to Joe Teamster and his truck.

The NRA-ILA suggestions are pretty good, but you still want to double-check the state laws for each one you will traverse just to be safe.

Overall you're on the right track. Some things to consider is that you won't be going through states with super restrictive laws like NJ. You're going to be traveling through states who mostly have right to carry laws. Although you're not actually carrying loaded weapons, it shows a certain respect towards your rights.

How much ammo are you talking about? 1000rds, 100,000rds? The reason why I ask is for a lot of cops working traffic, out of sight is out of mind. It comes down to you. For a cop working interdiction, more questions will be asked, but it still comes down to you. Are you a nervous wreck, beyond what is normal for a typical traffic stop? Is there some other mitigating circumstance besides a traffic stop that is going to give the cop PC to get in your car? The overall question is "why would an officer get into your car and find your legally owned and transported firearms?"

Cool. I have maybe 100 rounds of .45 ACP and a few hundred rounds of 7.62 x 39. The rifles are an OLD Enfield that is really more of a curio piece than anything I'd cycle a lot of ammo through and an SKS. The pistol is a single stack Ruger P90, no modifications.

EDIT: I just spent a moment reading the link from Ryoder. I guess it sounds like (given that one firearm is an SKS) I'll take the ammunition with me (the movers have ammo on their "we won't move it" list) and EITHER let them move the handguns OR have my wife take the firearms to an FFL once I get out there.

Remember to have at least one scary looking gun near by, so when you're pulled over you can hold it up and show the cop as he walks up to your car. Most cops are gun guys/gals and will appreciate it. They have egos, though, so they'll also get their gun out to show how much better their gun is...

Get a couple good black pelican cases and a TSA locks and just bury them in the trunk.

Put the ammo in another case and bury it as well.

As Dave said you are not going thru the nutbag states that froth at the mouth about weapons. Check the lists of regulations.. you will be fine.

Two easy steps.
1: Spend a couple hours at the range and burn up that ammo. No ammo to transport = no problem there.
2: Ship firearms from one FFL to another if you are worried. Personally I would put the unloaded guns in locked cases in the trunk of the car.

True story, I was shooting to qualify on the M9 before my last deployment, and the guy next to me was having trouble even hitting the target at 7 (yes, SEVEN) yards. He asked me how I was keeping my groups tight and what my job was, and I explained that my dad taught me how to shoot at an early age, and I was a pilot, I asked him what his job was, and he casually replied "security forces." Oh crap.....:S

Here's something from the Federal side (18 USC 926A):

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.



Given this, if you have the guns and ammo in separate locked cases in the trunk, it seems you'll be ok from a Federal standpoint.

That said, I'd still doublecheck the individual state laws to make sure you don't get popped for anything, but I doubt you'll get in any trouble if you're in the passenger compartment and the guns/ammo are locked in the trunk.

I used to think so as well, until this incident. Then I realized that no matter what the law says, it only takes three assholes to send you to prison: one asshole to charge you, one asshole to prosecute you, and one asshole to find you guilty and send you to their chosen "pound me in the ass" facility.

One can only hope that Mr. Aitken is pursuing proper legal channels to have his conviction overturned, have his commutation improved to a full pardon and expungement, or at the very least have his rights restored. Otherwise he still has a felony conviction on his record and no vindication.

When you get to the AZ border feel free to load and holster the pistol. You may then carry it open or concealed or under the seat if you like. If you are moving to the Phoenix area stop on out to Canyon Lake and ask for James at the marina.
