One can only hope that Mr. Aitken is pursuing proper legal channels to have his conviction overturned, have his commutation improved to a full pardon and expungement, or at the very least have his rights restored. Otherwise he still has a felony conviction on his record and no vindication.



I don't necessarily disagree with your point, but there are differences between Aitken's case and Elvisio's situation.

That gets really expensive. For example, to ship a handgun by UPS it must be done "next day air" service, which runs about $80. And the FFL on the receiving end will charge a fee for his services, usually $20-$25, because he's going to have to go through all the paperwork and background check to transfer them back to you again. And what if the background check is denied because of some mix-up? Then you don't get your guns back.

Just put 'em in your trunk, unloaded, ammo stored separately.

Actually, I am just eyeballing that list and they all look like reciprocity states. If so, you could get a concealed carry permit and be good in every one of them.

ETA - Yup. According to this website http://www.usacarry.com/concealed_carry_permit_reciprocity_maps.html your VA concealed carry permit is honored in each of the states you cite.
I know it just wouldnt be right to kill all the stupid people that we meet..

But do you think it would be appropriate to just remove all of the warning labels and let nature take its course.

His concealed carry license (didn't realize he had one, I must have missed mention of it) only covers the pistol, and he still has to follow the various state laws regarding concealed carry. It doesn't cover the rifle, and for that his best bet is still a locked case in the trunk, separate from the ammo.

Hmmmm...Alabama law just refers to weapons. It looks like VA does make such a distinction by calling it a concealed handgun permit. Weirdos.
I know it just wouldnt be right to kill all the stupid people that we meet..

But do you think it would be appropriate to just remove all of the warning labels and let nature take its course.

TX also has specifically a concealed handgun license, but in TX, open carry of unloaded long-guns is legal as long as you're not "brandishing" (which has case-law definition meaning at minimum to hold in a menacing manner).

So in TX, he's fine. Even without a CHL in TX he's fine with the pistols in the car.

Before I got my CHL, the first question out of the officer's mouth when I got stopped was usually "do you have any guns or drugs in the car". Now it's more typically "are you armed today sir?" Followed by "yes, right hip" or "yes, center console". I've never had an officer hold my weapon for the duration of the stop (which wouldn't bother me a bit), and have always gotten a warning when I was armed.

Moving from VA to AZ? Good for you! F*** the East Coast, especially VA! They don't call it "The Old Dominion" for nothing!

There is a dz.commer who has a lot of experience with respect to the crossing of state lines with firearms. I am surprised he has not shared his thoughts on this as he probably has more first-hand knowledge of the subject than anyone on the forums; however, out of respect for his privacy, I will not identify him.

Alabama is a problem state - they don't have concealed carry themselves, don't recognize other states CCW licenses, and don't even allow loaded guns in cars while traveling across the state. Beware.

Gun Owners Protection Act of 1986 cleared this issues up. You are allowed to transit THROUGH any STATE as long as it is not your destination. This includes overnight stops.

The guns need to be "secured" and unloaded unless the State says something different.

If you have an iphone, there is an App called "legal heat" that is a guide to all 50 states' firearm laws. it covers CC, open carry and transport rules as well as additional info. It's easy to use and understand and comes in handy when ever you have questions.

or one can file a 'gun travel plan' with big brother

that way when they watch your gun GPS tracing log, it's not a surprise

and those hotel/motels can be informed ahead of time to not allow you to stay there

...

You can mail the long guns to yourself through the US postal service, the handgun can be sent to yourself by fed ex (this is brutally expensive, but ). Ammo can be shipped UPS, but is generally not worth the trouble.

My experience with the post office is that you won't have any trouble if you don't tell them what you are shipping. They have to ship long guns, but it avoids a lot of discussion if they don't know what you are shipping. I try to avoid boxes that scream GUN (receivers in flat rate boxes, barreled actions in poster tubes). Not that you only need to ship the portions with a serial number on them; the rest is just parts.

Note that as long as you are legal at the start and end of the journey and follow a few simple rules, you are, in theory, protected by federal law while in transit. The concealed weapons permit doesn't really matter in this situation, other than to establish that you are a law abiding sort if it becomes an issue.

In my experience, movers may or may not handle the long guns, but definitely not the handguns. The advice from the moving companies has been universally bad: from "you need remove the firing pin and cut the action with a grinding wheel" to "Just slip them into the boxes after we leave".

No. Although it's legal to ship firearms to yourself under Federal law via a common carrier (no transfer has occurred), when I tried in 2006 I found that Fed Ex policy had changed and that they'd only do shipments where one party has a FFL.

So shipping via Fed-Ex will require either an ignorant counter clerk, at least a C&R FFL (which isn't needed for federal purposes), or or boxes that are just marked "sporting goods" (which might make it harder to make a claim when a Fed Ex employee or contractor steals your guns).

I have no idea how legal it is to ship things in violation of common carriers' tarriffs or terms and conditions when you're not breaking state or federal law.
