jimmytavino 16 #2 December 22, 2010 probably not a 1st amendment issue. I saw on the news that he's being charged with interstate trafficking of obscene material. read about this guy a while ago and thought then,,,,, that his "instruction manual" was lame, and wrong and a perfect example , that ANYone, can "self Publish" just about anything... I'd say. " Throw "THE BOOK " at him " hahahahah idiocy abounds, hiding behind perceived "rights".. what a world.. jt

All obscenity laws in the US implicate the 1st Amendment. I don't know what's in the book other than a vague description of it in a news article. But if it's words only, or words accompanied only by non-photographic illustrations, then most of the more recent caselaw to date says that that's on the "legal" side. If there are any actual photos of anyone who was a juvenile at the time the photo was taken, that could trigger illegality, depending on what's depicted, and context. I apologize. It a hot topic on the radio this morning. I was planning to start a thread on it anyway, had you not beat me to it. Since the DZ.com rules say that anything discussed must be done in a factual context of a social/political issue, we just need to be the adults we all are and discuss it on that level. I'm sure we can. ETA: I respectfully suggest you can restore/retype your OP without there being any breach of propriety. This is an interesting and timely topic that merits reasonable discussion. Meso, are you comfortable with it being discussed on this level?

DiverMike 5 #10 December 22, 2010 As disgusting as the subject and author is, words are just words. As long as they are not threatening or libelous I don't see how they couldn't be protected under the 1st amendment. That assumes there are no photographs or even a line drawing that can be considered obscene. I don't think a 'how-to' manual about committing any other illegal activity would send two LEOs to extradite. It appears to me to be political grandstanding and has no hope of being successfully prosecuted. It may be successful in a local Florida court, but it will be overturned. I guess the intent is to cause monetary damage to the author. For the same reason I jump off a perfectly good diving board.

If it breaches obsenity laws then the full weight of the law should be brought to bare on this sick individual. When an author is too meticulous about his style, you may presume that his mind is frivolous and his content flimsy. Southern_Man 0 #12 December 22, 2010 I'm pretty much a first Amendment absolutist, which puts me in the uncomfortable position of defending even objectionable material. I really haven't followed this controvery, so I am unaware of what is in the contents of this book. As long as it is words, drawings, etc. it is hard for me to see how it would not be protected speech. Pictures of underaged individuals are another matter. I think marketplace solutions (boycotting any publisher or distributer who carries this book) is the best solution."What if there were no hypothetical questions?"
