Wrong Court Ruled On Arizona Law

You would be able to understand this all better then I.

Does a state actually have the right to wage war like that article says? If the drug wars in Mexico encroach on the peace and safety of El Paso TX. Instead of these bullets hitting buildings they start killing U.S. Citizens. The Federal Govt. does nothing like the pretty much are now. Can Texas or Az. actually wage war?

Nope, one rancher is still in jail for holding a group of mexicans at gunpoint, until the border patrol came to pick them up, (he had lost several cattle over the montsh to butchers)

He was arrested for false inprisonemnt!

And his land is VERY will posted in spanish!

Plain talk is what I understand. Seems to me, we have the 'National Guard' in each state. The governor of each state can call upon the Guard to protect their state. The National Guard has been called-out during factory strikes and 'race riots'. Seems to me, they should be able to call-out the Guard to protect our border cities. Do we have to wait for an all out attack from drug cartels and mass blood shed? Wait a second... aren't all the Guard units in Afghanistan and Iraq? [:/]

In order to wage war, you usually need an army. Generally speaking, states don't have those.

State Defense Forces generally operate with emergency management and homeland security missions. Most SDFs are organized as Army units, but Air and Naval units also exist.

A case involving a State vs. the Federal Gov't in a matter of immigration is not necessarily an appropriate case for the SC to be obliged to exercise it's jurisdiction? The cases cited were State vs. State or State vs. City.

Edit to add: Does a State vs. Fed Govt. case begin with a lawsuit filed by A.G. Holder or did it begin with the Federal Court decision last month?

OK, I will admit I was not aware of these SDFs. Seems like they could certainly be deployed in emergency situations much like the National Guard. Could a state "declare war" or "wage war" using these SDFs under the US Constitution? Only Congress can "declare war", but we've only formally done that a few times. I don't see why a state couldn't legitimately use these SDFs in legit emergencies.

Did the newsman mis-speak or did he quote the note as (approximately) "This is a federal agent and this is what will happen to others who support the cartel." ? That doesn't make much sense to me if it is members of the cartel who are doing the killings.

Considering that the drug cartel activity coming up from Mexican doesn't seem to present any challenge to the sovereignty of California through Texas, no. If the Mexican Army was mobilized on the border then could see it becoming a situation where the governor calls out the National Guard if the feds do nothing. But there is also the situation where states are precluded from treaties, etc. The feds keep the states together and manage international affairs.

A state going to war is just silly. What? Will the Arizona National Guard attack across the border?

Nope. Could you imagine Reuters reporting that Arizon crossed the border and attacked Mexico? Wage war? If Mexican troops were amassing that would sweep in and plant a flag then yes. It could go to war. I don't see that going on now.
