There is actually very little discretion for a judge with mandatory sentencing guidelines. Steal gum? You bet. Steal a slice of pizza? Yeppers. The example is disgustingly valid. IT shocks the conscience how valid it is. Prop 66 a few years ago would have gotten rid of this petty theft with a prior rule. Too bad the correctional officers union didn't like it. You simply cannot believe that such a rule would exist or be enforced as it is. But it is enforced with alarming frequency. You don't want to believe it because it shocks the conscience.
