It's kind of strict liability; you didn't go, you derelected duty, refused orders, etc. And he's an officer? I do recall a guy killed himself when GWB was reelected, so the nut-factor is everywhere. Common sense does not exist in the system. Furthermore, his plea that Obama isn't a US-born citizen does not constitute a defense, just a mitigating factor at most, after he's convicted.
