The latter is actually a crime, not suspicion of a crime, so that's off the board as too extreme for your example.

He measn like the guy who shot a county council member is teh ass as he was trying to kill her, then he gets 15 years and is alomost out; can you still detain him on the possibility and suspicion he might go kill her?

Now you're getting into a convaluded mess when you start talking about reasonable expectations.

Could you arrest someone for murder because they had ak-47's in their house? No.

Could you arrest someone for having fully auto ak's? Yes

Would the suspicion of auto ak's in the house be reason enough for a warrant to search the house? Yes.


Your first question was pretty cut and dried. Then you tried to jump about 9 levels and make it apply to an entirely different situation. Nice troll, again... but completely rediculous.

Depends on what the "reasonable expectation" is based on.

For example, if somebody makes credible threats against the President of the US, at the very least, he'll be arrested and locked up for at least a little while. If that same person not only has been making threats but showed up to a venue with a weapon, he might be lucky to get out of that situation alive.

So, can you be a little more specific in your hypothetical?

I'll take No, for it is not with in our legal powers to arrest people on speculation for $500.

Even in cases where there we arrest someone on charges of hiring some one to kill some one, we can't simply do it based on thought. We have to wait till funds are made available and transferred which demonstrates intent.
Simply saying you wish to kill some one......doesn't hold water in a court of law.
Life through good thoughts, good words, and good deeds is necessary to ensure happiness and to keep chaos at bay.

So based on your logic he could take you out prior to you taking him out?
And that's why people we have something called law that relies on something called evidence and logic not "i had a funny feeling....." or the ever popular "I spoke to god and god said I should......."
