If we take a closer look we can see that legislation fom both parties infringe upom these rights in our constitution! Habeas Corpus habeas corpus n. Law A writ issued to bring a party before a court to prevent unlawful restraint. [The basic premise behind habeas corpus is that you cannot be held against your will without just cause. To put it another way, you cannot be jailed if there are no charges against you. If you are being held, and you demand it, the courts must issue a writ of habeas corpus, which forces those holding you to answer as to why. If there is no good or compelling reason, the court must set you free. It is important to note that of all the civil liberties we take for granted today as a part of the Bill of Rights, the importance of habeas corpus is illustrated by the fact that it was the sole liberty thought important enough to be included in the original text of the Constitution Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. Freedom of information act. In a proposed bill if you publicly announce a view point the counter view point must be given equal time! We can say whatever we want as long as it is agreeable to the mahority and doesnt offend anyone. How long will it be before it is mandated that noone could should or can be offended ny the words of another? One side declares that the availability and pesence of gune leads to violence and crimes. another side declares that the presence of guns in law abiding citizens hands limits crime. Some say that the secound amendment was instuted to prevent foriegn invasion and create a militia to respond to an atteck, and that this is no longer a vialbe reason for the populace to arm themselves. Since our military is strong and capale. Another veiw point is that the populace must be capable of arming themselves in the event that the government becomes Tyranical and and armed revolution my be neccesary! AND, that history has shown taht disarming the populace is a prelude to tyranical action. --------------------------------------------- The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized In these time of suspision and fear any whisper of terrorism or finger poiinting of drug dealer can be construed as probable cause! Emails phone conversations all can be siezed to gather information before being charged with a crime. meerly suspision can cinstrue actionable warrants. One word Guantanimo One more word...Eminent domain Personal real estate has been siezed by the state and even federal goverment and given to private corporations for development of a capital enterprixe "deamed Good for the state" without just rcompense for the original owner. "SORRY BOUT THAT" Property forfiture laws have been inacted to FIGHT THE WAR ON DRUGS. Any person ACCUSED of drug dealing can have his home car bank accounts siezed immediatly after being charged with a crime. the assests are sold in most cases before the accussed even goes to trial. If found inoccent the assets are gone. with little or no compensation. How long will it be before you can lose everything you own becase your niebor doesnt like you and points a finger at you and says "Terrorist"! In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence, Trial by jury or trial by media. Public oppinion weighs heavily of the process. not truth or justice. Assistanc of competent and interesteds council only for those with money to buy thier way out of it. The rest of us get overworked public defenders or a deamed eligable to afford our own lawyers. A case of mistaken identitty could cost you everything you own even if you win the case. 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction When the government or a corporation can attach your paycheck or bank accounts without due process that involves you "working" for free. Sounds like slavery to me. to fix the health care issue it has been proposed to mandate by law that everyone has health insurance. How long will it be before we are mandated by law to be employed to fix the unemployment problem? We are no longer able to "Disapline our children but are yet responsible for thier behavior How long will in be before it is mandated that all children are given over to governmental disapline trianing. If a drunk man confronts you on the street and you defend yourself you can be charged with assault and held liable for the "Victims" medical care. In some school sports are being eliminated because it causes inferiority feelings in those kids who dont compete well. It has benn instituted that anyone involved in a fight in a school gets expelled even if one child just got hit and didnt respond. both kids are expelled. The proponents of this action say that this has lowerd acts of violence in the schools.. Wrong, it has lowered reported incendents in the schools. How long will it be before rape victims are jailed as well. will this lower rapes accross the country? How long will it be before recreational sports like skydiving rock climbing, scuba diving are banned for our own good. Good productive citizens wouldn't particpate in such activities would they. Its counter productive! How long will it be before the government will tell us where we will work for how much and what we can do with what we earn.
