I remember reading a tax court opinion a while back where the IRS argued that a taxpayer who had prevailed in a matter where the IRS alleged he owed several times more than he did should not be entitled to an award of costs as the prevailign party. Why? Because Tax Code and regulations were so confusing that there is no way that the IRS can be blamed for its position. And to think, the IRS itself scratches its head. My best friend works for the IRS advising companies on matters of international tax and providing opinions on how the taxes are to be treated. The opinions do not shield these companies from paying taxes if the IRS determines they should have paid more - it only shields the companies from paying additional penalties.
