livendive 8 #3 January 16, 2009 Quote In its opinion, a three-judge panel of the U.S. Foreign Intelligence Surveillance Court of Review ruled that national security interests outweighed privacy rights of those who might be targeted, affirming what amounts to an exception to the Constitution's Fourth Amendment for cases that involve what the panel called government interests "of the highest order of magnitude." Exactly. Why would anyone be happy about a withdrawal or reduction of a Constitutional right? Blues, Dave"I AM A PROFESSIONAL EXTREME ATHLETE!" AggieDave 6 #6 January 16, 2009 QuoteThat's too bad. The Fourth Amendment is eroded a bit more. That's not just it this week! The SCOTUS voted 5-4 to basically do away with the fruit of the poisonous tree! Personally it scares me to no end. Professionally it scares me to no end. This decision shows that officers can make an unlawful arrest and that evidence located after the unlawful arrest can and is admissible in court. The case in question centered around an arrest that was made in good faith; however, it was still shown to be unlawful since the officers made the arrest off of the NCIC hit and not with in-hand teletype confirmation from the ORI. I really don't like the idea of adding to police powers at the expense of personal rights!--"When I die, may I be surrounded by scattered chrome and burning gasoline."
