Debt collectors get power to use force on debtors

The government has been accused of trampling on individual liberties by proposing wide-ranging new powers for bailiffs to break into homes and to use “reasonable force” against householders who try to protect their valuables.

Under the regulations, bailiffs for private firms would for the first time be given permission to restrain or pin down householders. They would also be able to force their way into homes to seize property to pay off debts, such as unpaid credit card bills and loans...

When ya win in Small Claims Court and the Defendant doesn't pay; the Sheriff's "Till Tap" is pretty cool. They never see it coming... Sheriff walks in, opens the cash register, takes out the money and gives them a receipt. Priceless.
Nobody has time to listen; because they're desperately chasing the need of being heard.

lawrocket: Doesn't that sound like a bounty hunter or repo man? Ever see a sheriff execute an eviction or a writ of execution? That's here in the US, John...

Yes, but that's different. Bounty hunters deal with felons who haven't shown up for court and need arresting. I'm all for that. That's a far cry above the seriousness to society of a defaulted loan.

A repo man doesn't take things by force - he gets things by being sneaky, like towing your car in the middle of the night. And if you come out and confront him, threatening to escalate the situation to violence, then the repo man just abandons his efforts.

TrophyHusband: my question is, if someone who is NOT law enforcement breaks into your home and tries to take your things by force, can't you just shoot them?

That's what I would do, as well as many other Americans. These bailiffs in England may not have that problem, since the citizenry doesn't have guns any more with which to defend themselves.

Yes, that's the way these things should be handled. Civil forfeiture, sheriff seizure, repossession, etc. The goal can be accomplished without force, and therefore force should not be authorized.

"the life of a repo man is...intense.";)
