As used in this statute, `fraud' or `artifice' shall not be construed to mean a promise of future consideration." Massachusetts is trying to pass this law. If you tell a girl at a bar that you are a doctor and she then sleeps with you, does that mean that you are a rapist, or is she just a whore? Depends whether a reasonable person would only sleep with you if you really were a doctor. I'm more wondering how this will get used in statutory rape defenses. quade 4 #4 March 13, 2008 Let's break this down; Quote Whoever has sexual intercourse or unnatural sexual intercourse . . . Does not "unnatural" sexual intercourse already fall under the set of sexual intercourse? Ok, minor point, but I think where they must be going with this is "gay and lesbian", but clearly that's simply a bullshit way of trying to say something that is already obvious; gay and lesbian sexual intercourse is still sexual intercourse. Quote . . . with a person having obtained that person's consent by the use of fraud, concealment, or artifice and who thereby intentionally deceived such person so that a reasonable person would not have consented but for the deception . . . Ah, so now with the previous clause deciphered this becomes a bit more clear what they are probably talking about; being taken in by trannys and "The Crying Game". And I'll now refer to this law as the Danny Bonaduce Law. This is especially clear when you consider the built in loop hole for "normal" relationships; Quote As used in this statute, `fraud' or `artifice' shall not be construed to mean a promise of future consideration. So, guys you're still safe to say things like, "I'll marry you if you give me a BJ."quade - The World's Most Boring Skydiver

TrophyHusband 0 #9 March 13, 2008 i hadn't though of the tranny aspect. there's only one problem though, wouldn't the decption be revieled before you actually have sex? i thought it was in response to this: http://www.boston.com/news/local/articles/2007/05/11/court_rules_sex_through_use_of_fraud_is_not_rape/ i didn't realize that other states already had this kind of law. i wonder if anyone has been prosecuted in those states for bullshitting a girl at a bar. without looking at the laws of those states, i wouldn't know if that exemption has been made. its nice of massachusetts to exempt promises of the future though. lawrocket 3 #11 March 13, 2008 Think of the situation where the person thinks it's someone else. In "Single White Female" when the boyfriend thought it was Bridget Fonda's character having "unnatural sexual intercourse" with him. THat's like the "fraud" aspect. It's why the "reasonable" person standard is in there. "such that a reasonable person would not have consented but for the deception." This means that a woman saying, "He said he was a plastic surgeon" probably wouldn't be a "reasonable person." My wife is hotter than your wife. jakee 1,596 #13 March 13, 2008 A friend of mine used to try and pick up girls by telling them he was either a) the guy who put the stripes in toothpaste or b) the ghost of the local haunted castle. Is that reasonable? Do you want to have an ideagasm?

lawrocket 3 #15 March 13, 2008 Quote"He told me he was single. I would not have slept with him if I knew he was married." Is the the statement of a reasonable person? It's difficult to say that woudl work under established rules - particularly in the criminal context. There was a case I read once where the guy lied and said that he was infertile. They had sex and she got pregnant. It was not a "rape" because the consent reflected the character of the touching. This is why a person substituting as someone else would be rape in this. Ever see Revenge of the Nerds? When Louis disguised himself to have sex with Betty, he committed a rape in most places. Apparently, the law has a loophole in Massachussetts. That loophole would be closed. My wife is hotter than your wife.

So if a girl goes to the bar at time of her periods (knowing that a reasonable person might not have consented), finds a nice guy, and leaves with him without telling him the truth - it looks like he could file a rape charges (or rape attempt charges), because he was intentionally deceived.* Don't pray for me if you wanna help - just send me a check. *
