Aldrin could probably argue that he felt threatened with immediate bodily harm, given the asshat's actions/body language. Actually it's a grey area depending on state. Trust me. I had a fight w/ a neighbor awhile back. Spent a couple hrs. in jail. There are two separate things t think about - criminal versus tort. I really can't comment on criminal defenses since I haven't done anything regarding criminal law since I studied for the bar exam. However, in the tort system, Aldrin would have to prove self defense, meaning that he "reasonably believed" that the guy was going to harm him; and that he used only the amount of force necessary to prevent the battery. I don't think this dude was going to actually hurt Aldrin, and words alone cannot constitute a battery or an assault. On the other hand, this dude's in a pretty rough spot. What's he gonna do? Is he actually gonna sue and say he got his ass kicked by a geezer? Video of the episode would also be used, in which case a jury may very well conclude that he had it coming. While, as a matter of law, Buzz would be convicted and/or held liable, this is exactly the kind of case where "jury nullification" would be a strong possibility. My wife is hotter than your wife.
