kelpdiver 2 #51 November 22, 2007 QuoteQuoteWhen you have 4 judges out of 9, that is a stacking. You need only one more like minded person to get a majority. Yet one would hope that with the long terms of SCOTUS judges they'd be able to drop the pretext of strict party affiliations and interpret the laws and Constitution as a responsible third part of the government. True, they may be appointed by Presidents, but they certainly ought to act on their own. Certainly in the past there have been ones that turned out radically different than expected, but lately they seem more like a cabinet member for the standing President. When the current Supreme Court voted to weaken students' recognized first amendment rights, while strengthening recognized corporate free speech rights in a separate opinion released on the same day, it should have been clear to most people that the SCOTUS does not consider the Constitution to be the most important consideration when deliberating.
