1969912 0 #1 October 24, 2007 Soon after passage of CA AB 1471 requiring microstamping technology on all new handguns (lest they be placed on the "unsafe handgun" list), the CA Assembly realized that for microstamping to be effective, shell casings form criminal shootings must be left at the crime scene. LEGISLATIVE COUNSEL'S DIGEST AB 3M TA3, as introduced, Feuer. Firearms: Retention of Shell Casings. Criminals may attempt to circumvent the intent of AB 1471 by removing shell casings from the scene of criminal Handgun shootings. This bill will prevent that and make all crime-related shell casings available for microstamping analysis. This bill will make it a Class III felony for any person who has used a Handgun in a criminal shooting to remove shell casings produced by that shooting from the crime scene. Additionally, any person convicted of removing shell casings from a crime scene will be permanently placed on an Unsafe Criminal List, which will be maintained by the DOJ. No person on the Unsafe Criminal List will be permitted to commit future crimes. AB 3M TA3 also makes it a Class III Felony to possess or sell "Brass Catchers". Brass Catchers are containers attached to Handguns which are intended to capture spent shell casings. Brass Catchers could be used by criminals to aid in circumventing AB 1471. There is no sporting use for Brass Catchers. Improvised Brass Catchers are considered to be Brass Catchers for the purpose of this bill, therefore any person in simultaneous possession of a Handgun and an Improvised Brass Catcher is in violation of the law. Improvised Brass Catchers are defined as any container (lunchbag, backpack, hairnet, purse, man-purse, condom, air sickness bag, Dbag, etc.). The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. Vote: majority.
