I wonder if his excuse would be that the bill requires two different providers of technology, but the fact is it is easy to have providers when it's not required to prove efficacy. and of course it doesn't get around the fact that shell casings found on a scene would never meet judicial muster in a trial. Or that it's easy to pick up your brass, or use revolvers, or get a gun prior to, or modify your current one. I believe it has to mark in two separate locations. And the information includes the make, type, and serial, which seems like a lot of data to encode in scratches. ALthough having the make/ type blah blah seems all a bit redundant if you are keeping a DB anyway of these things, why not just have a serial number and everything else held electronically.
