Like for example the woman in the Duke case. I believe if it were proven beyond a doubt that the accuser is lying they should serve the prison term of the accused would have. The PC police will never let that happen. They believe that doing so would scare women who really have been raped out of making the report and the accusation. Watch an episode of COPS and you can begin to see the real-world application of such thinking. Honestly, if I were a woman, I'd be really angry at the stuff that the authorities are doing in the name of "protecting women." And example: When cops show up at the home of a woman who has called because of a domestic fight, if there is a shred of visible evidence that he may have hit her, they will arrest him regardless of whethe she screams up and down that she doesn't want to press charges, doesn't want him arrested, etc. The reason they do this is because they are worried that the woman may truly want a prosecution but is terrified and living in fear of what he will do if she swears out a complaint against him, and they don't want an abuser to not be caught for it just because he has the woman too afraid to come forward. So the reason I'd be angry if I were a woman is that the authorities are telling me that I'm too stupid/afraid to be able to tell when I really need my S.O. arrested for beating me. They have removed my own discretion, and insulted me by implying overtly that I cannot possibly have the fortitude to make the decision on my own. Perhaps we should bar all prosecutors from saying what defendants are being prosecuted for.... just present the evidence and let the jurors decide what crime was commited and what sentence is appropriate. The difference in this case is clear. There's a difference between a clear cut crime and one where the circumstances may not legally amount to rape. If the jury are to make an objective legal determination on whether events & circumstances amounted to rape then it is prejudicial to have a parade of witnesses call it rape before they deliberate, but perhaps you have a taste for miscarriage of justice. Like it or not the law gives the judge the power he exercised. The "victim" & others then engaged in a publicity campaign to influence the trial outside the courts and compelled the judge to declare a mistrial.
