Specifically I am looking for anything that has to do with "ficticious tags" or vehicle registration. I have done a search in yahoo, but that has not turned up anything. False evidences of title or registration It is a felony for any person to commit any of the following acts: (1) To alter, with fraudulent intent, any certificate of title, registration certificate, registration plate, manufacturer's certificate of origin, or permit issued by the office; (2) To forge or counterfeit any such document or plate purporting to have been issued by the office or by the manufacturer; (3) To alter or falsify, with intent to defraud or mislead, or with intent to evade the registration laws, any assignment upon a certificate of title or upon a manufacturer's certificate of origin; (4) To hold or use any such document or plate knowing it to have been so altered, forged, or falsified. § 27-14-302. Penalty for felony Any person who is convicted of a violation of any of the provisions of this chapter or by the laws of this state declared to constitute a felony shall be punished by imprisonment for not less than one (1) year nor more than five (5) years or by a fine of not less than five hundred dollars ($500) nor more than five thousand dollars ($5,000), or by both such fine and imprisonment. That led me to find this also,.... 27-14-306 Improper use of evidences of registration (a) No person shall lend to another any certificate of title,registration certificate, registration plate, special plate, or permit issued to him if the person desiring to borrow it would not be entitled thereto, nor shall any person display upon a vehicle any registration certificate, registration plate, or permit not issued for the vehicle or not otherwise lawfully thereon under this chapter. Acording to this I got shafted,.....I was issued a ticket for driving with ficticious tags,... The car I had just purchased from an individual and still had the plate on it. I got pulled over for not wearing my seatbelt, and then was issued a ticket for the ficticious tags. I went before the judge and was found guilty,....but acording to this statute,... no law was broken,...because the tag that was on the car was issued to that car,... no where in the law does it say anything about the tag being issued to the person. -------------------------------------------------- I am a greek midget Quote Share this post Link to post Share on other sites
Andy9o8 2 #4 November 30, 2006 NOTE: THIS IS NOT LEGAL ADVICE By driving the car with the tag on it, you were technically displaying it. However, lack of "guilty intent" (it's referred to as mens rea) is a defense to a criminal or quasi-criminal (like a traffic) charge - assuming the judge accepts your story as truthful. Logically, that likely means either (a) he didn't know the statute, or (b) he didn't believe you. I'd urge you to consult with an Arkansas attorney to determine your rights, such as whether there's time left and/or a legal or factual basis to file an appeal.
