Since we've been on smoking lately

Now I think HOA's suck to start w. And if these condos are built so shitty as to allow cig. smoke to go into another condo it's prolly time to sell. But why not THEM?. Or is it a neighbor beef? I don't agree if you own the place they (HOA) can change rules in mid stream. Fuckin lawsuit hungry motherfuckers are the main cause me thinks.>:( LOL. That's one of the down sides to living in an HOA. The board can amend the rules pretty much whenever they want (depending on what the rules were to begin with). The best recourse is usually to get friends together and vote out the board (since most people in an HOA don't bother to vote, that sometimes isn't hard) and change the rule. Or move.


I'm moving into a condo in a few months, and I'm a bit worried about the association thing, but most of the CCRs seem reasonable.

It sounds like the neighbors had been upset about it for 5 years before they resorted to changing the rules, if these smokers had given a shit about their neighbors and tried to do something about it instead of adopting a "we can do anything in our apartment" attitude they wouldn't be in this position.
Changing rules mid-stream, that is like saying the local city can't change it laws after I move into town.

That's the biggest moot point of all time. I can't understand why anyone would buy into an HOA the second time.

As for changing CC&R's, they can do it. They tried to change ours to disallow us to rent out the dwelling, only good ole boys of the association board... it failed.

Oh contrare, these things take a vote that equals to over 50% of all the units, so you have to have over 1/2 the people show up. SOme are supermajority.

No, the way the rules are changed and the board is elected differ by every community. Sometimes it's a 50% vote, and more often, it's a majority of the votes cast.

In my last neighborhood, newer single family homes started in the $700s. Town houses and condos close to work suck less than big mortage payments, parking on the freeway every morning and afternoon, or spending your mornings and afternoons on a bus.
