QuoteThe guy was obviously out of line for threatening one of the flight crew. But the bigger problem is, as many people suspected would happen, that the Patriot Act is being used outside of its original context. It was bound to happen. So many people who supported it from the beginning said it would not be abused because the purpose of the Act was to prevent terrorism. But here we go....

Does anyone know what the charges are? The only mention I could find of Patriot Act or terrorism came from non-US sources. None of the US media sources I checked mentioned those hot button topics. Keith Olberman(sp?) didn't mention it.
Long before the passage of The Patriot Act, it was a federal offense to threaten, harass or intimidate a flight attendant. From what I've read, the charged couple scored a trifecta. It doesn't matter how shitty a flight attendant acts, you can't pull the kind of nonsense those two pulled on an airliner.
It's about reading comprehension, folks. Get it right before sounding off..... in the wrong direction.
Speaking of reading comprehension the flight attendant is a man.

Not really. He kissed her neck and then had his head on her lap. Big deal. Keep reading though, and it gets really funny. The flight attendant tried playing some stupid game with the passengers where they would try to guess the age of the flight attendants, and the defendant said "let me guess, you're 12 years old?!" This is part of the intimidation charge. I don't think that will fly.
They were upset because the flight attendants refused to serve them alcohol becuase of their kissing. They had not drank any alcohol before requesting a drink.

Yea, I read the rest of it. When you continue to badger a FA to the point that the Captain turns on the "fasten seat belt" lights so that the couple will stay in their seats, and then the dude threatens the FA again saying there's going to be serious confrontation between them after the flight, you're asking for it. I loved the part when he asked the FA if the cops were going to be waiting for him and stating that he wasn't "going to go quietly". The dude was just begging to get arrested. He should have just taken his companion to the bathroom and gotten it over with in the first place.

If I were to say it it would me something to the effect of "I'll have your job for harassing me". Prolly what he should have said in this day and ageQuoteSo, my wife can't lay her head in my lap? Or, as it is now to be known, my "huge cock area." Or is it OK if I just don't smile at the time?
Serious consequences is not necessarily a mortal threat. That could mean almost anything.

If the threatening passenger was prosecuted under some other law that wasn't called "The Patriot Act", would you still object?

I said before if he is drunk and disorderly then charge accordingly...I dont want ANY precident set to arrest people far all kinds of percieved"crimes" by our government in the name of national security.

Interfering with a flight crew. This isn't a bar on Main Street, this is an airliner in-flight with numerous other people on board who are not acting like dumb-asses.
If this was Main Street USA then yes Disorderly Conduct and Alcohol Intoxication.
Again I see no mention of the Patriot Act, this type of activity was illegal long before this occurred.

QuoteDo you think that passengers should be able to threaten flight attendents and not be prosecuted for it?
If the threatening passenger was prosecuted under some other law that wasn't called "The Patriot Act", would you still object?
No. I wouldn't object if he were prosecuted under laws that already existed. I have a problem with "expanding" the use of the Patriot Act to prosecute people for things that are obviously outside the original intent of the Act.

QuoteI Googled their names and read about 10 other sources for this story including the WaPo and none of them mentioned them being charged under the Patriot Act. Only the one you cited from Sydney Australia mentions the Patriot Act.
Why do you think that is?

A couple's ill-concealed sexual play aboard a Southwest Airlines flight from Los Angeles got them charged with violating the Patriot Act, intended for terrorist acts, and could land them in jail for 20 years.

Let’s stipulate that the seats of a commercial airliner filled with other passengers is an inappropriate venue for sexual exploration. Can we nonetheless agree that this is not what the PATRIOT Act was aimed at?
Face it the FEDS arrested them under provisions found in the patriot act. AND NOW they are under surveillence by the FEDS till Feb.
I guess if you do not hear it on the EIB it is just not NEWS

As a matter of fact, they ARE NOT being prosecuted under the so called "Patriot Act". They are being prosecuted under Title 49, USC 46504, which is something else entirely:
http://www.law.cornell.edu/uscode/html/uscode49/usc_sec_49_00046504----000-.html
It clearly says so in the last page of the affidavit:
http://news.findlaw.com/cnn/docs/crim/uspersing91806cmp8.html
The whole Patriot Act link is just more media BS and sensationalism, and once more shows that you cannot trust anything they say (well almost anything, they did not make the whole thing up

Cheers,
Vale
so you're saying everyone wins in this case then
