Scottish laws give them so much freedom. There is no such thing as PACE (POlice & Criminal Evidence Act) up there and if you so much as fart in public it can be construed as Breach of the Peace..

but yeah your absolutely right, its ridiculous

In defence of the Procurator Fiscal Service (:S) there is a problem with sectarian violence arising from Celti-Rangers matches. The whole Catholic - Protestant thing spills out from NI to Glasgow in almost undiluted form.

Boruc WASN'T cautioned for crossing himself. He was cautioned for the circumstances in which he chose to cross himself. This is less about religious freedom than inciting violence.

Incidentally, a Scottish Caution isn't the same as an English one - there's no criminal record involved. In effect, he got a letter from the PF telling him that he "could" have been prosecuted for his actions, but isn't being on THIS occasion. In common parlance, he's been TELL'T to behave himself in future.

That would & should have been an end to the matter, except for the local Catholic Church deciding to bleat about it and create a fuss.

Yeah... We don't have PACE. We have The Criminal Procedure (Scotland) Act & various evidential rules which give an equivalence to English Law, but a different way of getting there.

We also have a wide range of "Common-Law" crimes, including the wonderful (and jealousy-inspiring) catch-all "Breach of the Peace". Acting in a riotous or disorderly manner to the alarm, annoyance or disturbance of "the lieges" :)
The nice thing about this particular crime is that it's very open-ended & vague. It also carries unconditional powers of arrest - VERY useful for getting control of a situation where you're unsure just what you're going to report someone for at the time.

As Y'All foreigners may gather, English cops don't have this particular tool available to them... And they're envious!:D

But not necessarily of action, particularly if their action incites others to commit crimes or is in breach of public peace.

For example, in the current climate, a person may be a visibly devout Muslim, but must accept the personal consequences were he to shout: "Allah-u Akhbar!" (God is Great) as the plane he's on takes off!!:o OR a Sikh may wear his ceremonial dagger in public without fuss, but if he's shouting that he's going to kill somebody, then he can expect an offensve weapon charge to be added and arrest to be more immediate.

It's all in the circumstances.

To be honest I didn't see the incident so yeah, its all context, I agree. But damn, anyone should be able to do whatever they want when it comes to that. If a muslim player had knelt down and started mock praying there wouldn't have been a word said because we'd have been too scared to take any action in my opinion.

Nor would there have been any action if a French Player buggered the first person he caught after scoring, it is far too common afterall.
