Oh, but according to the leftists on this board, the Phelps family has a "right" to routinely demolish the emotional lives of people in their most vulnerable hour. :S

I'm SO glad people with more sense than those on the left are in power. The Phelps family needs to be forced into a less detructive way of expressing themselves. They do MUCH harm in the name of free speech, and to supprot them in that right is pure bullshit.

They won't run out of money.... the ACLU will defend the bastards for free I'll bet! We should all get behind the ACLU since they defend our rights... well, except for second amendment rights. Never mind. They're trash, just like the Phelps family.

Well, much like the Klan and Aryan Nation the less attention these lunatics get, the less we will hear from them. I went to their web site once and found it to be appalling. I mean really shocking.

It's an unfortunate price we all have to pay for free speech.

As for the ACLU, they do defend our rights. Our rights to be as openly insane as we want to be. It's also our right as citizens to ignore, or take appropriate legal action where we see fit.

As for the 2nd Amendment I think the NRA has that well in hand. Don't think it will be repealed anytime soon.

And they defend the non-existent rights of illegal immigrants as well. In fact, they try to overturn legitimate votes, through judge shopping, since it just isn't what they want the world to be. They had a chance to do many good things, they just got carried away with their own arrogance and became the bleeding heart legal mafia. Their hypocritical stance on gun control is just an easy way to show how full of shit they are.

The bad thing about this situation is that all of these "Phelps" suits will tie up our legal system in the name of something that almost all Americans know is wrong.

I raised this before:

Since the Phelps Family are so keen of the right of free speech & assembly, I'm sure they wouldn't object to a 24/7 demonstration outside their homes. Perhaps celebrating the music of Marilyn Manson, Eminem, Alice Cooper, etc... played continuously & loud as an expression of the demonstrators' beliefs. :)

I'd be willing to bet that in the circumstances, such a demonstration would be accepted (even supported) by neighbours, and that the police would attend to ensure that there was no breach of the law.:)

Please show me where in the text of the 2nd that it states you can own a gun. I'm a pro-gun guy, but the Constitution doesn't give you the right, they've just decided not to revoke our guns yet.

Not defending the Phelps group, but it is distrubing the peace to take a protest to a neighborhood. I seriously doubt it would play out this way.

I have read it many times and it does state that the "People" means the same as it does in the rest of the US Constitution, unless you think the Authors used the term "People" differently in this case, unlike all the other times that phrase is used it that wonderful document.

If it was the gov't trying to stop the nutjobs from demonstrating at the funerals, then yes the ACLU might step in. This is a civil case between two private parties. The ACLU could care less about such matters.

It would be nice if it actually turned out that way, but I doubt it would because that would make too much sense. I do not understand why, but it always seems that "rights" apply only to jackasses, yet when you try to beat a jackass at his/her own game, the very system which stands by allowes them to act like that will suddenly start intervening when you do it in return. I am only basing this heuristically on personall experience, and I am sure there is some section of some legal code that someone can quote to me to prove me wrong.

Is it your belief that you (or anyone) could kill an illegal immigrant and face no legal punishment? Might want to rethink your statement.

They have a pretty defined stance on gun control; they believe that the second amendment refers to the right for militias, not private citizens, to own guns. You may disagree with it (I do) but your disagreement with someone does not make them a hypocrite.

Yeah, I realize it often does seem that way. It's probably because the jackasses, being, well, jackasses, get a disproportionate amount of publicity. But of course, those same rights protect our ability to post any social/political commentary that we want on these boards.

This is in no way a defense of jackasses in general, or the Phelps in particular, but...
the First Amendment protects jackasses in large part because popular speech needs little protection; it is speech which is very unpopular that needs protection in order for true freedom of speech to exist. So, in the US, a large part of the function of the First Amendment is to protect speech which is very unpopular.

Part of the price of having freedoms is that sometimes the way others exercise them can be downright nauseating.

Here's where your logic is again flawed... who would ever think that the opposite of the ACLU is Falwell and Limbaugh. I'd think the opposite would be level-headed lawyers with no agenda.... either that, or people who aren't insane with their own egos to the point they think they have a duty to always end up on the wrong side of a fight.
