guilty or not?

What should be his punishment? Your attached article is about two people, yet your references here are to "his" and "he", or just one person. So, we can't respond to your question because we don't know which of the two subjects you are talking about.

I see this as 2 seperate questions. First he seems to be asking us whether or not they are guilty, which of course is absurd unless you have been sitting in the courtroom daily during the whole trial and even in that case it would just be an opinion.
Secondly he seems to be inferring they are guilty, which if this is the case, why bother asking us if he's already made up his mind, and then asking what we think the punishment should be in which case, I would answer, "depends on what they are found guilty of." ;)
