I believe life in prison carries a minimum sentence of 30 years, which recently changed to 40.

The fundamental problem with the death penalty is the complete inability to reverse it.

The fundamental problem with the whole Criminal-Justice system is it's adversarial basis.

When something (say a murder) is perpetrated, then the police officers are under pressure to "get a result" (a "result" - somebody charged & put to court - is a success & the path to riches & power is paved with such successes).

Then we come to the "Glorified School Debate" which is the court process. One team whose SOLE purpose is to prove the accused's guilt and another team whose SOLE purpose is to prove the accused's innocence. Once againthe path to riches, fame & power is paved with "successes"!

Is it really any wonder that the search for truth is lost in this maelstrom of people striving for success? Is it any wonder that any achievement of justice in such circumstances is purely accidental?

Would you trust YOUR life to such a system?

No, not intirely, but I do carry a gun to help even the odds, or increase my odds. But I believe a large number of us although verbally do not support a death penalty would in fact kill if required to.

But it is a choice, not everyone would and thats why some of us have to step in and place ya in a body bag and try to find the guilty party.

If you were replying to me in this, then you are off on a tangent. We were talking about keeping the victim's and jury's and court's emotional content out of the process - how hard that is - and that judgements need to be driven by objectivity and facts, not emotion. That applies to sentencing of any crime, not just those eligible to the death penalty.

Your point is pertinent to the topic, but not as a reply to our tangent.

Edit: to yours, I think 'deterrence' is a side effect of punishment, not the prime reason nor should be considered in how the system is structured. The purpose is to keep those specific individuals capable of repeating an offense from doing it to someone else - the other stuff has to be secondary to that (deterrence, closure, rehab, etc.)

Err... How does a gun help against the Criminal-Justice System? Shooting your way out of an arrest or court wouldn't exactly be seen as a sign of innocence!!:S

Why does someone NEED to die? Does revenge help at all?



In my opinion, nobody NEEDS to die. I'm following the pro-death penalty rethorics here. (I do not support it)
