The pledge ruled unconstitutional in public schools

That is a mighty big assumption... I don't care if there is a reference to God in the pledge, on a building, or on our money... I don't think that those things, in and of themselves, rise to the level of establishing a state religion (which is one of the things the 1st prohibits)...

The DofI is a founding document, it says what it says and there is nothing that can or should be done to change that... but also recognize that the DoI was written before the Consitution and Bill of Rights... the instrament used to separate us from Britan is not the same instrament used to establish how our government is to work.

I don't think our money should be changed, or buildings modified, it would be a waste of money...

I don't have a problem with the 10 Commandments being displayed in a courthouse, becasue in a historical context, they are part of the foundation of our legal system.

Again, I don't care if "under God" stays or goes, its a non-issue to me... from a legal standpoint, there is probably a better argument for it not being there... the judge should have just said the '54 law adding "under God" was unconstitutional and that the original must be used if recited in school, rather than saying you can't say the pledge in school.

I'm not sure of his point there, but:

I'm pretty sure we are all full of ourselves. I'm about 95% full of myself - the other 5% is mostly chimichanga right now and a bit of Dr. Pepper. In a moment it will also be considered a bit of myself.

One might ask you, how much of what you are filled with isn't considered 'kallend'?

Why would activist left wing judges do that? If we continue to add people like Roberts (or at least what he seems to be) you won't have to worry about it.

If something like that happens, Congress can simply clarify the law as part of their jobs, effectively bitch slapping the SC for crossing their job descriptions.

Just like it happened with the abuse of the emminent domain thing. Oh wait, nevermind - congress doesn't have the balls to do their jobs directly, they just tied federal funding to it to pretend they did something.

Some have said I'm full of --it, but I think "full" is an exaggeration.

Oh please. If a future Supreme Court decides abortion is illegal, and creates new law while forcing their view of morality on america, you'll be applauding them for 'protecting the rights of the unborn' or something.

Their JOB is to interpret the constitution and decide people's rights in accordance with that document (and with more recent law.)




Personal question - if SC decides to arbitrarily find a way to make your CAFE standards law of the land (or Kyoto or whatever), would you stand up and clap your hands? Or bitch slap them for doing congress's job?

If they tried to pass such a law? I'd be against it. If they found such a law, passed by someone else, to be constitutional? I'd be all for that.

I would be against it since it is not the SC's job to pass laws, but determine their constitutionality (based on the Constitution of the UNITED STATES only).
