Yeah, you're right. The robber does reach for his gun after he goes down. It's likely he pointed at the clerk while lying on the ground so the second hit was probably justified. I still think the clerk is going to have legal problems for the reasons we have already mentioned.

Those were my thoughts. Loking at it a second time, the robber was shot. He loses his gun.

Then, the clerk approached to the robber's left. At about 19:35:21 the robber reaches with his right hand for his gun and retrieves it. At the 19:35:24-25 mark, you see the robber apparently point his gun at the clerk to get a shot off. At 19:35:26 clerk fires again. This may still be self-defense.

On the third shot, however, you can see the robber's right hand with the gun on the ground, not pointing towards the clerk. The clerk finished him off.

Whether the second shot was defensive due to clerk's duty to retreat depends on the state law. But the third looks like it may make a homicide.

I think the clerk better just hope to go before a jury.

That guy was still moving around and was still armed and dangerous (for all the clerk knew). All the clerk has to say is "I feared for my life." I would have shot him as many times as I could in that kind of close in firefight. Chalk one up for the good guys.

Or "I was so frightened. He was shooting at me and all of the sudden everything went blank. I have no memory of what happened. Next thing I remember, I was standing over him with a gun in my hand and the robber was lying on the floor dead."

You know...
The sad thing is, you're probably right. He'll probably get into some kind of trouble for shooting more than once and not aiming for the ankle or some shit like that. What is wrong with our culture??? That guy comes in with a gun pointed in the other guy's face threatening to kill him if he doesn't give him all his money and we're worried about how many times the guy shoots to defend himself. He should have completely emptied his magazine into that guy. If he was still moving after that, he should have picked up a bat and caved his head in. That guy threatened his life with a pistol. He deserved to die. A wounded person can still kill you. He already made his intent clear. It's either the clerk or the robber. I choose the clerk. Christelsabine obviously automatically chooses the robber. :S It never ceases to amaze me.

I understand your anger and agree...especially being a clerk...I see his side...If it is between him and me...and I am armed, know how to use the weapon in my hand and even after one shot do not feel that I am safe...oh darn...he's a gonner...Sorry...As far as I am concerned as soon as you walk up to a person pointing a gun in their face and yelling for me to give them all the money in the register/purse/wallet/etc. You took your rights of life, liberty, pursuit of happiness and threw them out the window...:S[:/]B|...

If some one pulls a gun on me, I'm giving him every bullet I have untill I know that I'm out of danger.
I think that was a justified shooting.

i'm surprised no one has come up w/ any other facts on the case, re: the 3rd shot and the moving of the body. interesting to me was (what I think I saw) in that after the perp went down behind the clothes rack, it appeared to me that the clerk realized he just possibly killed a man and appeared to be yelling at him or saying something. it reminded me of that scene in The Untouchables where Kevin Costner killed a perp and then yelled at him for not just putting his gun down, "why didn't you just listen?"

if anyone gets any other details, please post 'em.

as Kim du Toit says, another one for the good guys, another goblin dead. hate to sound caloused (sp?) but the perp made his bed and is now lying in it.

Couldn't it be argued that lacking the medical training to rapidly determine weather or not the second shot caused enough damage to render the robber incapacitated, the clerk had no choice but deliver a third shot to be sure that his life was no longer in danger?

Besides we can't see what was going on the other side of that clothing rack. Perhaps the perp was raising his weapon for one last shot. After all the video did clearly show the perp pick up his weapon after he had dropped it when he fell but the video does not show if the clerks second shot found it's mark. Perhaps he missed.

As to why he moved the body, I'd guess that he did that to avoid a costly carpet cleaning bill. It is not as if the forensic guys would need the body laying in state to determine what had happened. They would use the video for that
