lawrocket 3 #1 February 17, 2005 I think this is good news for many reasons. First, it will prevent, to a large extent, "Forum shopping." One of the key considerations for asshole shysters is to find a jury pool that is sympathetic. Many of these locations where one can expect to find jurors likely to award ludicrous damages are in the rural South state courts. Second, it will put some control over attorney fees. Class actions are good for attorneys. Class Action Attorney's are good at getting 2 million people a 500 dollar non-exchangeable coupon. The 10 attorneys will then divide up 100 million in attorney's fees. Or try, until an attorney comes in to object saying the attorneys are getting too much, at which time 110 million gets divided 11 ways. The new statute will help alleviate some of this practice. I read about the Dems talking about this law sticking it to the people. Hogwash! All this law does is try to help prevent fat-cat attorneys from exploiting vast numbers of the population. I've got my issues with Republicans, but I commend them on this one My wife is hotter than your wife.
Nightingale 0 #2 February 18, 2005 I think most class actions should be federal. They tend to affect people across the nation, rather than in just one state.
