Gun Export Question

When I grew up (in small town rural Canada) everybody had guns...22's, deer rifles and shotguns. I learned to shoot on a Winchester Model 75 22 LR of my dad's. Foolishly, I let him get rid of his guns a few years before he died.

Recently, I have been wishing I had that gun to teach my sons how to handle firearms and shoot. I have been trying to find one for sale in Canada with no luck. I have seen several for sale on websites for U.S. gun dealers.

I have contacted a couple of these dealers and they just say they'd have to get an export permit and that they aren't going to do that. Does anybody on here have any experience/knowledge they could share with me on exporting a gun from the US?

(Of course, I will comply with the Canadian gun ownership requirements of acquiring a Firearm Actions Certificate - which includes getting my wife's permission - and then registering the gun when I buy it.)

Until you started talking about that $2 billion waste of taxpayers money, I was going to tell you that a friend of the family is always trading away some part of his collection. (commonly referred to by hoplophobes as an arsenal) He wants nothing to do with registering his guns or fooling around with bureaucracy, especially foreign bureaucracy.

I have worked with a few FFLs here in the states, but I don't know anything about export licenses. That could tell you something that none of them had one.

(FFLs are licensed firearms dealers in the USA)

From the BATF FAQ's:

(L2) Does a licensee need an export license to export a firearm?

The GCA does not provide for an export license. However, firearms and ammunition shall be exported in accordance with provisions of the Arms Export Control Act of 1976 and a license must be obtained from the Office of Defense Trade Controls, PM/ DTC, SA-6, Room 228, U. S. Department of state, Washington, DC 20522-0602; (703) 875-6644. In the case of exporting NFA firearms, a permit, ATF Form 9, must be obtained from ATF.

The export of sporting shotguns is regulated by the U. S. Department of Commerce. For further information, contact them at their nearest district office or the Bureau of Export Administration, Export Counseling Division, U. S. Department of Commerce, 14 th St. & Pennsylvania Ave. N. W., Washington, DC 20230, (202) 482-4811. [22 U. S. C. 2778, 27 CFR 179.114-179.116]


GCA = Gun Control Act
NFA = National Firearms Act, which regulates machineguns.

The silly gun laws require that we make sure that you aren't arming Canada to invade the U.S. and take over. You would think they would make an exception for single purchases.

The DTC has a website: www.pmdtc.org/ I can't seem to get in right now, but you might try it and see if you can find a form to apply for the export.

It looks like you would have to transfer the firearm to someone to a dealer that has an export license, so that he can then forward the gun to you. And that's gonna cost extra... It appears to be quite a hassle to register to export guns, for a dealer who doesn't do it frequently.

Thanks guys. I will try and see what I can accomplish.

It's hard to believe that 40 years ago I took my first earnings from my paper route and bought myself a Cooey semi-auto .22....without anybody's permission or permit. And now of course in the socialist paradise of Canada I have to jump through a million hoops and get my wife's permission to buy a .22. Getting her permission is likely the hardest thing to do as she completely buys into the gun control mentality without really understanding what she is supporting.

My husband laughed when I read this and said that maybe you just need a new wife... (j/k)
Seriously... if all that is true, then you probably need to chat with her. Cuz whether its bought up there or imported in, you would probably still need her to sign whatever.

Yes, it's true, according to a local gun shop owner that I spoke to...I need her signature. In the Firearm Acquisition Certificate process there is a form that she has to sign. Without that, I'm hooped.

I find it pretty incredible that a person who is 52 years old, no criminal record, never been arrested, a professionally designated accountant can't buy a bolt action 22 calibre rifle to shoot tincans with....like I did when I was 12.

As far as getting a new wife goes, if I was to get divorced I am sure that she would still be able to put the kibosh on me acquiring a firearm. It's ridiculous but that is the way it is in Canada.

I'd probably say then that if you want to own it rightfully, you and her need to have a chat. Otherwise, talk with one of your other buddies and see if they would get one. Then see about a person to person transfer. I have no idea what the laws up there are on person to person sales though. Anyone else know anything about that?

Same deal...I have to get an FAC to buy a gun from anyone. The firearm has to be registered in our infamous waste of money Gun Registry and if sold has to be re-registered.

I'm not going to go through the hassle until I determine how difficult it will be to import a gun from the U.S.
