If suspected of DUI through observation, and field sobriety testing, you are required to take a breathalizer, blood, or urine test. If you refuse, you're automaticaly charged with the crime_______________________________________________________________________________________ Here in Ca. last year a coworker got a DUI . No accident or anything and the forcibly took blood from him at the police station. I don't know the outcome of that one. In PA if you are stopped for suspicion of DUI and you refuse the blood/breath test, your license is automatically suspended for one year, even if you are later found not guilty of the charges. How do I know this? It was on the test I took yesterday to wipe a couple points off my license (and I got that one right!) Instead, police officials said they are talking with administrators at Hennepin County Medical Center (HCMC) about the issues raised by the incident. The hospital is reviewing its policy and other regulations to clarify what may have led the doctor to believe that he needed a written court order to take the blood sample, a spokesman said.
