He can name somebody now and go through hell trying to get him confirmed (unless he makes a truly non-partisian choice but even then it would be dicey) or he can wait until after the elections and make a lame duck appointment that will be seen as partisian no matter what. Further, if he doesn't choose before the election AND we're struck again . . . he's really screwed for not doing everything he can.
