Hell of a gamble either way.

Here's how I see it.

He can name somebody now and go through hell trying to get him confirmed (unless he makes a truly non-partisian choice but even then it would be dicey) or he can wait until after the elections and make a lame duck appointment that will be seen as partisian no matter what.

Further, if he doesn't choose before the election AND we're struck again . . . he's really screwed for not doing everything he can.

I think the best strategy would be to find somebody that everyone in the intel business respects and name him as quickly as possible, but this -will- be interesting to track.

I agree. I think Bush will try beforehand. He had the quote about SH's "intent" to use WMD's. It looks like he's already floating trial balloons to see whether it works.
