As I said, I think we SHOULD be able to do all those things. We should also be able to picket and protest and attempt to turn business away from places like that through lawful means. I believe that if a restaurant wants to cater to only smokers, they should. I believe that if a restaurant wants only to serve whites, it should be able to. I disagree with the people who would do that, and would think they're bigoted racist assholes, but I would support their right to do it, much as I would support the rights of women to form "women only"clubs, blacks to form "black only clubs" and gasy to form "gay only clubs." The restaurants cannot do that because of a Supreme Court ruling citing the commerce clause in katzenbach v. McClung 379 US 294 (1964), which was argued with the Heart of Atlanta Motel case. So, it's well settled that there are limitations to this conduct under the Civil Rights Act. Frankly, I disagree with it, but I live with it, and I'm sworn to enforce it. As long as the people working there aren't exposed to risks from the smoke, no problem. Employers do have a higher responsibility to their employees than they have to their customers.
