You know, if he's found guilty, and sentenced to prison, it's pretty much gonzo-time for the guy. lawrocket 3 #9 April 22, 2004 In California, they both accomplish the same purpose. Both the Grand Jury and the "Preliminary Hearing" are used to determine whether "probable cause" exists. Grand Juries are actually a bit of an oddity in Cali. The prosecutor has the discretion of whether he wants a Grand Jury to indict the suspect, or whether he'd rather have the court make a probable cause determination to go to trial (Federal Courts use the Grand Jury far more often than Cali Courts do). Typically, after a guy gets pinched, he'll have up to 72 hours for his arraignment, where the judge determines what bail should be, if any, and where the initial plea is entered. This is also where there is often a first plea bargain. Once the arraignment occurs, if there is a "not guilty" plea, the sides exchange their evidence. Then there is a preliminary hearing. In the case of a Grand Jury, the evidence and proceedings are held in secret, and the Grand Jury decides probable cause. Or, in a preliminary hearing, the court decides. THere must only be admissible evidence sufficient to show a prima facie case (that is, meeting all the elements of the crime.) SO, Both Grand Juries and Preliminary Hearings do the same thing. One is done by the court, the other is done by a quasi-judicial body. Note: Santa Barbara County uses the Grand Jury a lot. My wife is hotter than your wife.
