I never thought I would say this about very many skydivers because I generally think most of the family is pretty cool, but here is one for ya....

A friend of mine found a Stiletto he wanted on DZ.com classifieds, contacted the seller, agreed on a price, mailed a check and was expecting his canopy this week.

WELL.....seems after all this the jerk was offered more money than what he agreed upon with my friend so he is backing out of the deal.

I realize we are all in to getting the most we can for our stuff, but to do this to someone without calling to give him a chance to at least meet the price was just plain out horrible.

I personally can't make up my mind if I hope the guy who bought the canopy cuts it away and never finds it....or, if the seller looses his new one on the first jump. (Sorry Skybytch...but I may need to borrow your handle for a day or two!:o)

So who do you guys think is right??????? The seller or my friend....

Don't wish bad things on anybody...bad karma!!! What the seller did was definately crappy, but the buyer may not know about it...anyway, what size stiletto is your friend looking for?

Well... what your friend should have done was one of a few options.

A) Inspect the canopy before paying for it so that when the money was sent they already had the canopy in their care.

B) Inform the seller that they would pay for express shipping if it was something that they had their heart set on.

C) If your friend talked the buyer down from the original price, and someone offered more then the base price and had the money that day... just don't bitch. Just deal with it. Its the same as a house... some one talks the seller down 5k, then buyer 2 walks in with cash for 3k more then the asking... the seller would be stupid to turn it down.


I was all set to buy a canopy, withdrew the money from my savings and everything, was going to over night the check and include prepaid shipping back to me to make sure I got the canopy. I called the night before I droped the check in the mail and was informed that the seller had a cash offer and they were bringing the amount of my check plus $50 more and the canopy was no longer for sale... I just got over it since the seller was needing cash for bills and it would have taken 5 days for my check to clear.
Yesterday is history
And tomorrow is a mystery

Um, not if an agreed upon contract has been reached. If there is an acceptance of the offer, and consideration has been exchanged, a seller cannot just decide to not sell it to the first buyer anymore. A contract is a contract. The seller should not have accepted the offer if they thought they could get more for their house. Now, there are ways to get out of a contract if need be, but that wasn't the example ;). However, your example works as long as there is not a contract.

However, in this particular situation, I tend to think that yes, Mouth's friend got screwed. But such is life, unless there was a written contract. I also tend to believe in fate - and that karma's a bitch. And that's not wishing ill on anyone. I also believe that things happen for a reason, although we may not know the reason right off.

Tell your friend that something better is around the corner, and get him walking around the block...

Well, yes, in certain circumstances, a verbal is as good as a written one, but if you had to go to court to enforce performance of a contract, how would you be able to demonstrate that the contract was made if the other side decided to lie? And in circumstances wherein a contract is typically used, as in real eatate, to NOT use one tends to flaunt "typical and normal" procedures...all which a court looks at when deciding things like this.

I mean, look at it in this way: you give an employee a verbal warning that he has violated some rule. It's important that you note his personnel file, right? To show that the warning was made? It can now be argued that this is not a verbal warning, as it was noted into the file, and thus written, instead....for your protection, so that later, you can point to that if needed and say: "well, he was warned"....

Between ladies and gentlemen, verbal is good as written. However, I generally protect myself from rakes and rogues, especially in business;), and write everything out. Been burned once too many times. I'm glad you haven't, though! :)

More importantly... what about someone's WORD? Have we sunk so low that what we say is no longer worth anything? Hopefully most people would have the integrity to honor their agreements. I've bought many thousands of dollars worth of equipment from strangers via the 'net. Money first, then gear. I guess I've been lucky to always have gotten what I expected and no renigs on any deals.

i have to go with the "your word is your contract" people here, not that it is a big deal to some people i guess, but for me, my word is the deal, even if it costs me a few dollars.

but to each his own i guess.

In Texas a verbal contract is legally binding for just about everything but land and such. Of course, there has to be an honorable 3rd party present to confirm the deal.

No, I am not going to take that too personally...I was just making a point that in real estate, you use contracts for a reason. And trying to explain a point using different examples. Sigh. I suppose I didn't make it clear that I operate on a different level in my personal life.

My word? If I've offered something for sale, and an offer comes in and I accept it, as long as the check clears, it's sold and gone. If I say somethine will happen, it will.

I think the point has been lost by the time it got this far. The discussion isn't to find out who is an attorney, and determine if a house sellers verbal contract is the same as a written contract. The beauty of skydiving and skydivers is that it is such a close-knit, small community, where everyone trusts everyone simply because we jump out of planes. I can trust other skydivers at my DZ that my PC-9 camera can lay around all day, and I know it will be there when I get back. In the very least, the guy who owned the Stiletto disappointed your friend, and didn't follow the unwritten code of conduct very closely for skydiver-to-skydiver transactions... But don't worry about legalities, just move on, people will always screw you over....

but I think the price was agreed on AND the check was in the mail. that too me was a bad call on the seller.
about that karma thing...Mouth your friend may be in store for a better deal. I agree things happen for a reason but most of the time its for GOOD reason. I would definitely be cautious about mailing transactions unless of course the sellerWASsome one your friends trusted...in that case the seller was just a prick who fukt his buddy over![:/]

OK, I'm over being mad. I still think my friend got screwed by a fellow skydiver; especially, since everything was in writing on the internet, but so be it. Some people really aren't nice even if they are skydivers....lesson learned.

Anyway....does anybody know of a Stilletto 107 (???) in good condition for sale???
