lawrocket 3 #4 April 26, 2003 Actually, the ruling does not say that file sharing is legal. It's a separate issue. The ruling held that the programs that allow file sharing are not illegal. As the Judge Wilson noted, this situation is on par with VCR's and tape recorders. Despite the fact that people use VCR's and tape recorders to pirate copyrighted material, they are not ilegal because they have legitimate purposes. The legality of VCR's and tape recorders does not implicate the legality of video piracy. Regarding Grokster and Streamcast, the judge stated fairly clearly that if people use them for illegal purposes, like pirating music, it is not Grokster's fault. The issue of file sharing was not decided. The judge only decided that the file sharing programs are not illegal. Commentary: Think of this as just like the gun issue. Just because guns are legal does not mean that murder is legal. The RIAA is using the same argument as the anti-gun crowd, i.e., because people koll others with guns, guns should be illegal.
