Pistol "Noise Suppressors" Legal?

Recommended Posts

I was getting all my ducks in a row for a trip this week to texas (printing out all the delta stuff for carry on allowances) i noticed on their website here that you can take a pistol with you.. and in your pistol case you can have a "noise suppressor" to me that means silencer, I thought those were pretty much illegal everywhere in the US can someone correct me?

It's a little like a machine gun - you can own one legally, but it's a huge hassle. HUGE.

By the technical definition, you probably have at least a couple of illegal ones in your home right now, if they wanted to bust you.

They are legal in some states. They are handled similar to full autos. In the fact that you have to apply for a license to own one and get aproved before you can buy one and also pay a $200 tax before they tell you if you can have one or not.

Noise suppressors or "silencers" are perfectly legal to own and use in the USA provided you jump thru the hoops to get one. If you want to buy one I suggest that you check out subguns.com and look on their recommended dealer listings for a dealer near you and contact them. They can walk you thru all the steps to buying a NFA item. I live in Texas and have three machine guns that fall into the same catagory as suppressors do. I must warn you that collecting class 3 or NFA stuff makes skydiving seem like an inexpensive hobby. Have fun! Pete

from my experience, in this case what they are referring to is the spongy egg carton shaped stuffing in many hard pistol cases.
The rules change from airline to airline...
But in most cases...a hard sided "unlocked' pistol case must be used.
With an identifying tag listing the contents as an "unloaded firearm"

By the way...the tag goes on the outside of the pistol case, NOT on the outside of the checked bag!
An idiot buddy of mine couldn't figure out why someone broke into his suitcase...and only took the gun!!

I've thought about getting into that -- I'd like a burstable M16A2 or a Mac-10 for my collection but the Class 3 tax law as I understand it would make purchase a $200 tax stamp if I had to get a replacement part for them each and every time. Maybe I'm mistaken on this though. Do you have any experience here?

I could understand a $200 license fee to get one, as there must be a lot of legwork involved so it seems reasonable there (sorta... )... but $200 for a new trigger mechanism that would only run me maybe $100 to start with is a little extreme. Put a $200 charge on top of a $1200 Uzi and that's not so prohibitive though.

You pay the $200 tax on the registered part of the machine gun. On my M-16 the registered part is the lower receiver. I can replace or change around any of the other parts just like on any other gun. Some other rules such as putting a short barrel on it do not apply because it is a machine gun. By the way, I haven't seen a transferable Uzi go for less than $3500 lately. Pete

You're right on the Uzi prices -- I must have glanced at at semi-auto knock off or something when I saw that. I'm not too into submachine guns so I couldn't tell you the difference at a glance if my life depended on it.

As far as the stamp goes though on the M16 lower, what's to prevent somebody from buying M16 replacement parts and dropping them into a semi-auto AR-15? As I understand it the lowers are pretty much the same if not identical. Not that I'd do that -- nor would I suggest anybody do. Do you just present your previously paid tax stamp when purchasing replacement parts then?

If this is just a one-time $200 tax per firearm I might actually consider doing it again. I was under the impression that I'd have to pay that $200 for every transaction related to any Class 3 parts for that firearm. Of course, trigger mechanisms aren't serial numbered (not that I've noticed at least) so they really can't track/tax them there.

I think my bank account might be taking a sudden hit again. Haven't bought a firearm since March so I figure I'm about due :P

There is a little more to converting an AR-15 than just dropping in some M-16 parts. It takes someone with a mill and drilling fixture to relieve the lower to accept the full auto stuff. The way that I look at it is that it costs much less to pay $8500 for an M-16 than to stay in the federal penn for ten years a count. Machine guns are huge fun. This is the time to buy. All of my class 3 guns have more than doubled in value in 4 years. (I bought my first machine gun for $550) PM me if you need help buying one. Have Fun!!! Petey

Flat and simple: where you live is a key factor.
Pennsylvania: as many as you want. must be registered with it's firearm.
Trick is------many pistols same size round=good for ALL ei. 9mm>.38>380 etc.
(I used to have an MP5/H&K with supressor but, it was made for THAT weapon only)
