PhillyKev 0 #8 September 12, 2003 There's an award? Seriously though, where's the slant in my original post? Tommy Chong was charged under Ashcroft's self declared paraphenalia crack down. RXService is being sued for marketing low cost prescription drugs to seniors. Those are facts.

kmcguffee 0 #10 September 12, 2003 QuoteRXService is being sued for marketing low cost prescription drugs to seniors. Using the same facts try wording it this way: RXService is being sued by the DOJ for assisting in the importation of unregulated prescription drugs to senior citizens. Since they are unregulated you can have this happen: Quote The FDA said the companies aren't just violating the law, but also endangering the health of customers. For example, FDA agents posed as customers and ordered Serzone, a powerful antidepressant, from Rx Depot. The company promised that it would ship a U.S.-made, FDA-approved bottle of the drug. Instead, Rx Depot shipped to FDA what appeared to be a counterfeit copy of Serzone, made in some country other than the United States or Canada, Hubbard said. I'm not arguing over who is right just that your "facts" were true but were slanted to the liberal side. "Any fool can criticize, condemn and complain and most fools do." PhillyKev 0 #13 September 12, 2003 Right, that's the legal basis they're using. But in actuality, the "counterfeit" copy is the exact same drug, made by the same manufacturer. But because it was made somewhere that the FDA doesn't have jurisdiction over, they don't recognize it as "regulated". I used to work for J&J and had to go through many FDA audits. I know what the beuracracy of that organization is like. It's one of the reasons that the drugs are cheaper. Not because they're made differently, but because they don't have to have an entire support staff and computer systems in place to make sure every i is dotted and every t is crossed. My last project there was installing compters enclosed in environmentally sealed protective boxes on the manufacturing floor of an over the counter production facility. The reason was the FDA required electronic copies of all processes be available at all times at every machine. For years, they had books around the floor, they would open the book and follow the instructions to clean out the gel dipping machine. But because of the new regs, they had to spend $12,000,000 and hire 15 full time employees, just to support an automated document system. They don't have those beuracratic requirements in facilities that are manufacturing for other countries, but they still follow the same procedures. And are able to sell the drugs more cheaply. Also, drug companies in other countries are prohibited from charging over certain legally mandated profit margins. They make much more profit here in the US where they don't have the same limitations. Not that there's anything wrong with them making a profit. But I don't think there should be anything wrong with consumers shopping for the best price, either. QuoteThe company promised that it would ship a U.S.-made, FDA-approved bottle of the drug. But if they did lie to the consumer, I can see a basis for it. But do you really think that's the prime motivating factor behind the suit? Or could it be that the drug company lobbyists have had some input because it's hitting their profits.

I probably shouldn't be making this post considering the new powers this nazi has at his fingers. The Tommy Chong thing....that's just STUPID!!! ask seniors on fixed incomes being charged exorbitant prices for prescription drugs that are being dumped in other countries such as canada and mexico at incredibly slashed cost. ever heard of casino buses or bingo buses, well in the northeast there is a booming industry of prescription busses, regularly transporting seniors to canada to get the SAME drugs at 50-70 % less. our senior citizens are voting with thier dollars. good for them. they know it isn't 'legal' but have been more that happy to go on national TV and talk about it. leave tommy alone, ashcroft. Every state, could have no problem with it. But since their business incorporates many states, the Feds, can step right on in. Good thing the republicans represent less centralized gov't, eh? BlueEyedMonster 0 #23 September 13, 2003 Regardless of what you wish. A law is a law. Ashcroft does not make the laws. As Attourney General his job is to see that the laws that CONGRESS passes are inforced. Yes I'm sure the republicans get lots of $$$ from the drug companies. But he would not have had the political backing to go after RX.com if they had not screwed up in the first place. I don't feel like looking it up, and you seem to leave out the details that don't support your argument in your orig post--So I'm not going to respond in reference to Tommy Chong, cause have no Idea who the hell he is.
