jmpnkramer 0 #1 November 4, 2003 O.K. so I was reading a thread and someone asked to not have pictures of them posted. Hmmmmmm. What kind of pictures are they? Here are a few thoughts: 1) If you are going to goto any type of skydiving facility you should know by now that there are going to be a ton of camera's. If your ugly well then sorry about your luck! 2) If the reason is that you are doing something you would not want proof of then I suggest you either not do it at the DZ or make damn sure there are no camera's within your vicinity. 3) You must realize that if a picture of you is taken then it is the property of the person who took it. Once again make sure it is one that you will not be ashamed of. I am sure I could make this much longer but I will leave that up to the fellow/fella compadre's on here. Why do professional photographers get signed releases from subjects unless they are being used in a purely news-related venue? While you do, in fact, own the image itself, unconsented use of that image (of a non-public figure) in many different ways could land you in very hot water. It's just more fun getting together the next day and figuring out what happened by piecing together everybody's memories. McDuck 0 #6 November 4, 2003 Perhaps we need lawrocket in here for this one, but it was my understanding that if you aren't using the image for the purpose of sales, whether of the image itself, or a product linked to the image, and you aren't trying to garner revenue from the image, then it isn't a civil issue. When I had drug dealers living across the street from me, and I was in the process of making life unbearable for them so that they would leave, I asked the police what was legal to photograph. They said that if it was visible from the street (public property), it was legal. Aside from all of that, I agree with the statement that if a person doesn't want their likeness used, why push the issue? If there was a picture of me that I did not want shared, I'd hope that my friends and fellow skydivers would respect that. Also, you know what? There are some people out there who need to learn a little tact when using a camera. Sure, some stuff is really funny, but other stuff is rather intrusive. It is a fine line. Yeah we can fall on the consideration and etiquette thing but once again don't do something at a DZ that you do not want on video and you do not have to worry about it. I have done some pretty insaen things in my time but I make sure that there is no evidence to prove and factualize what I have done. It makes for some Damn Good Stories though. weegegirl 2 #9 November 4, 2003 Again, what's the point? Sounds kind of stalker-esque to me. Why don't you grant people their freedom. The dropzone is supposed to be a place where you can feel entirely free to be yourself and at peace. Why ruin that for people by shoving an unwanted video camera in their face? Does this mean we shouldn't shower at the dropzone anymore because you may be hiding in the rafters filming us? Personally, I like "capturing the Kodac moment." I'm one of the video editors at my dz. I love filler footage for the End of the Year video - pie-ings, drunken moments, bonfire moments, etc. But if somebody asked me not to use footage - which they have in the past - I would respect that. Actually, Kramer is right, at least, he's right for the state of California. Other states' laws vary, so check your state. In California, if you take a photo of someone in a public place, doing something everyone can see (you can take pictures of people landing their canopies, but you can't sneak into the restrooms), then you're okay and own the rights to that photo. You can't go on to private property (tresspassing) and take photos, because thats an invasion of privacy. The courts would consider the dropzone a public place, because access isn't controlled, unlike someone's house. What you can't do: 1. Take a picture of someone on private property without their consent. If they're out in public, fair game. Even if you're standing on public property (the sidewalk) but shooting on to private property (through someone's window) that isn't allowed. 2. alter a photograph to defame someone's character (you can't take someone's head and place it on the body of someone who just did a naked jump to make it seem like the first person was the one who did the jump). 3. use someone's likeness, even if the photo was taken on public property, to promote or sell something without their consent. happythoughts 0 #13 November 4, 2003 The Girls Gone Wild folks addressed this very issue. A girl was at Mardi Gras and flashing the world. GGW got some video of it. They sold it on their video. Her father sued. The legal ruling was this: You lose your right to privacy if you do something in a public place. That is the law. If you want, you can f### over just about anyone using the law. However, do you want to see them at the dz every weekend? Lose a friend? How much would others trust you after that? Trust on any level? How about private conversations? I think that I would honor the wishes of that person. Some of my Rantoul pics were PMed to the subject instead of posted. That makes it their decision. Another thing to consider... the subject may get pics of the photographer at a later date... inebriated and whatever... Fortunately, I only drink on special occasions, so it is a non-issue for me. There is a difference between pictures at the bonfire and trying to catch someone in the toilet, shower, trailer, car or tent. Obviously some of us just like to expand things to the infinite dimensions to satisfy their own little world. That is what makes AMERICA so Great though.
