PhillyKev 0 #1 December 19, 2003 9th circuit ruled that ALL gitmo prisoners must get legal counsel and have access to US courts. It's being appealed and will probably go to the supremes. No link, read in one of those old fashioned printed out newspapers.
Jib 0 #2 December 19, 2003 How does the Ninth Circuit have jurisdiction over the military, let alone Gitmo? -------------------------------------------------- the depth of his depravity sickens me. -- Jerry Falwell, People v. Larry Flynt
PhillyKev 0 #3 December 19, 2003 That's been the question all along. Who does have jurisdiction over those prisoners? Exactly why they're being kept in a military prison on foreign soil in the first place. As an end around the judicial system. The judicial system is fighting back. Thank goodness. Jib 0 #4 December 19, 2003 The Ninth Circuit tends to be the most reversed; so, it seems like forum shopping having it there. I would think the Federal Circuit or DC would have been a more logical choice. -------------------------------------------------- the depth of his depravity sickens me. -- Jerry Falwell, People v. AndyMan 7 #5 December 19, 2003 The Libiyan in question has family in San Francisco, so the arguement is "if any court has jurisdiction, its the local one". The way that I see it, some court, somewhere HAS to have jurisdiction. Locking people up without trials is something that has been historically limited to the most tyranical regimes, and not a tool of the free. If in fact its the case that American courts do not have jurisdiction, I hope its only a matter of time before a world body steps up to the plate. _Am__ You put the fun in "funnel" - craichead.
