Yes, I have a Criminal Record???

So Im looking at filling out a lot of applications in the near future, and Im pretty sure most of them will be looked at pretty hard. Im not looking at how to get away with lying, Im trying to find out exactly how much info to provide and how to answer some of the questions. My record is 100% clean for the past 9-10 years. Is there a site where I can see exactly what potential employers will see?
An ap. asks about "ever been convicted of a felony, ever plead no contest, and so on...", well, no felonies, but the rest, I have no idea whats on my record.
I have nothing to hide, I just dont want to put unnecessary info in a potential employers decision process.

My suggestion would be to answer all of the questions factually. I would not, however, volunteer anything. We have all done stupid shit, and most employers know that. I have done my fair share of stupid and illegal stuff back in the day.

After college, I worked for a state government, and currently work for the Fed gov't and hold a top-secret clearance, and trust me, I know what the back seat of a police car feels like.

Just don't lie. If they don't want you, warts-N-all, fuck em'.

most employers, or potential employers, contract with an information gathering company to do pre-employment criminal background checks and credit checks. These investigative companies pull the aforementioned information in two ways, first off they pull your credit report from the three major credit reference companies next they access the FBI public records data base to see if you have been assigned and FBI number (anyone with a criminal history is assigned and FBI number) they then pull a criminal history from the public records data base. My suggestion to you is this, contact a local company that claims to do "preemployment background checks" it might cost you 50 or 100 bucks but have them do one on you to see what shows up in your criminal history file. PERSONALLY, unless your'e applying for a job in govt. or law enforcement, if it doesnt show up on your background check I wouldn't disclose it on my application good luck

My main concern is that I really have no idea what may or may not be on my record. I have a kind of, uh, interesting and, uh, confusing past that I'd really prefer NOT to bring to a potential employers attention, especially if its not even on record. Hell, DUI's for example. I dont even know if I have 1,2,3... convictions:S And if I do have.......convictions, are they gonna show up on a background check if they were 10+ years ago?

Im hoping to be able to somehow see exactly what comes up when my name etc. is punched into their computers. I know the DMV comes back clean (past 10 years).

I'm not sure. My latest background investigation cost the government 4K, and they only went back 10 years. I doubt many private sector companies would go to that expense. I will tell you this though, if you get hired after giving false info on an application or in an interview, and subsequently get fired for it, that will follow you around for a long time. Just be up front with them, then you won't have anything to worry about in the future if you get hired.

coupla quotes from My home town PD's web page. Since we're in the same state so I think this would be the most relevant.

32. Can my employer contact you and ask for my record with the Walnut Creek Police Department? It depends on who your employer is. Most government and state agencies conduct records checks on their prospective employees; however, if you work for the private sector, most likely a records check by your employer will be denied. Your record is considered confidential and not for public release.

16. Can I check my own criminal record? You can, if you apply directly to State Department of Justice. Contact their Records Review Unit at (916)227-3822. You must follow their requirements

freefalle's suggestion is probably the best first step.
You can, however, obtain a complete copy of your FBI
ID record under the Freedom of information Act...
Go to Google, enter; Freedom of Information Act request - this should yield needed information. It cost 18$ (2002) & you will need a fresh fingerprint set from your local PD.

CORRECTIONS;

Best firststep is probably;
Access your State record. In my state, (KS), this is done by going to the County Courthouse (Records).
Here, they provide you (& anyone w/ your name, dob, & ss#) with a computer...enter ID info...it spits out your State Record. (I believe this is the one most employers use...and could be confirmed w/ freefalle's method)
It is my belief that anyone accessing your FBI ID records needs a set of prints. (Including yourself)

The most recent change to the FCRA made criminal convictions reportable indefinitely. California still follows the seven-year rule (CA Civil Code 1786.18) as do some other states. To find the limit for reporting criminal convictions in your state, contact your state employment agency or office of consumer affairs. Other laws that should be considered:


Arrest information. Although arrest record information is public record, in California and other states employers cannot seek from any source the arrest record of a potential employee. However, if the arrest resulted in a conviction, or if the applicant is out of jail but pending trial, that information can be used. (California Labor Code §432.7).

In California, an exception exists for the health care industry where any employer who has an interest in hiring a person with access to patients can ask about sex related arrests. And, when an employee may have access to medications, an employer can ask about drug related arrests.


Criminal history. In California, criminal histories or "rap sheets" compiled by law enforcement agencies are not public record. Only certain employers such as public utilities, law enforcement, security guard firms, and child care facilities have access to this information. (California Penal Code §§11105, 13300) With the advent of computerized court records and arrest information, however, there are private companies that compile virtual "rap sheets."
