Because it doesn't have any floorspace within it except in the observation area at the top. It's a telecommunications tower with a platform at the top. Different structural requirements than an inhabited building.

Have you been there? When I was there, there was a bar, and a full service restaurant, a smallish movie room, gift shop and some meeting rooms. There certainly was more than just an observation deck.

But, if you don't want to call it a building. It is still the tallest freestanding structure in the world. :)

True and all are cable supported and not considered to be free standing, or house any observation decks, restaurants or anything similar.

Constructors and architects argue that a building is a frame structure made of walls and floors. Now CN Tower houses some occupied floors indeed, but most of the structure is no more than a concrete shaft housing elevators, and therefore it is not a building, one could argue. This is the reason why Jeff Herzer, and the Council on tall Buildings and Urban Habitat do not recognize CN Tower as the tallest 'building' in the world.
