Ok, this is shaping up to my worst week in a long time.

Arlo, march on over to RWS and make sure my rig is gonna be done on friday cause if I don't get some good news soon, I'm gonna explode.

Sydivingmovies.com has been shut down. The web host, with no warning, suspended my account. They consider the site to be a "dumpsite," which they say violates their terms of service. And that also means I can't get my money back. I'm paid up or a year.

Edit: Well, looks like theres nothing I can do. I missed this in the terms and agreements:

"Usage of allotted Resources. You agree that the use of the Plan(s) will not exceed the server resources (bandwidth, storage, e-mail usage, CPU) allotted to your Plan(s). If you use any resources that surpass the percentage or megabytes agreed upon, or if you exceed E-mail storage and attachment size limitations, Infinology may, in its sole discretion, apply additional charges, suspend the Plan's usage, or terminate this agreement. No shared hosting account is allowed to host scripts which consume more than 3% CPU and 7MB of memory per process. Infinology hosts production sites on production servers. Our servers are not to be used as a testing environment. Any website that causes downtime or heavy load on a server will be suspended without prior notification to you. Any site with traffic consisting more than 33% in file downloads (non HTML files) may be considered a WAREZ site and will be subject to immediate suspension without prior notice to you. In the event that Infinology elects to take corrective action, you will not be entitled compensation for any used or unused prepaid fees."

In other words, skydivingmovies.com was a warez site and I didn't even know it. Most expensive mistake I've made in a while. Ugh.

So that's that. It was nice while it lasted.

You weren't running a warez site. Bitch at them until they give you a refund of the unused months you paid for. If they won't, ask one of the lawyers that read the forums here to send them a threatening letter. They'll buckle if you put up a big enough stink.

I agree, Skydiving movies was insanly popular while it was around, and there are plenty of Jumpers on these forums who practice Law that can just send an intimidating letter.....

They are looking at statistics only. They have no idea what the site was. They just saw alot of up and download flux.

Try explaining to them what the site really is. That it is just movies for the skydiving community.

Naah, this was nothing automated. They didn't care what was on the site, only that it was using a crapload of their resources. I'm sure they checked to see what was on the site. In fact, when I purchased the hosting, they called me on the phone to confirm I had ordered it, and the guy, going only by the domain name, mentioned that streaming videos were not allowed. It was a good company. And I could get a dedicated server from them for only $90/month or something. Who's chipping in? :P

Damn bro, that sucks. That was one kick-ass idea and site.

I'd be willing to contrib a bit to a paypal account. Shite, you just need 6-10 people to donate $10/month and you got it. There's more than that on this site and rec. that would be willing to donate.

Can you see about getting like a 3-6 month trial deal and see how it goes ?

I think I'm ready to just give up. We'll see. Craig Poxon is looking into the bit torrent thing. I don't know what other web hosts would charge for a site like I had, but I think the best deal I could get would be a dedicated server at the same host I was at. And for a dedicated server, there would be no way to do a short trial. Setup fees are hundreds of dollars, and I think the monthly fee goes through the roof if you don't buy a year at a time. (The hosting I had woulda been double the price if I payed month by month).

The mistake I made was not doing a big test of the site while I could get a 30 day money back guarantee. I was just thinking this morning how smart I was to wait till the site was really finished before opening it up. But right up to last Saturday I could have gotten my money back... at least I think.

I've written the company an email asking for more details on why I was shut down and explaining some things. The more I look at it, the more I think I not have been violating their terms of service. I need to hear exactly what they believe I violated though.

So what I'm hearing is that 100GB a month in HTML transfers is OK, but using 33GB/month in binary transfers is WAREZ ? bullshit... I can't wait to hear the explanation from them on this one. I mean, you're paying for the bandwidth, and it's clearly NOT warez, and you're not exceeding the bandwidth per month allotment.

Ok I don't know alot about hosting. But I do know there are some hosts that will let you build a "dedicated box" ship it to them and they'll host it. Might cut some setup fees etc.. Just a thought. I did this for a year with an ISP here in Houston. I had some game servers I was hosting... I just used one of my old linux boxes

I still say we all chip in and get it back up. We all enjoy the site and I don't think it's fair for Dave to lose the money. You could do like a featured members part or something where the members who donate can put their videos, like a sub category like in BASE.

If I set up a paypal account for Dave, would anyone chip in[:/]

This is just an off the cuff idea, and may be TOTALLY impractical, but if enough people made a contribution to cover the setup and running costs - would it be possible to put a plan together for HH to expand this site and incorporate skydivingmovies.com?

I'm sure there's probably more limitation, restrictions and difficaulties to this then I know of/can think of, but it's just an idea :S

Yeah I just emailed them about that. I almost accused them of false advertising but I decided to just ask some polite questions for now.

I don't quite see how any website with pictures on it wouldn't violate the terms of service. I don't see how anyone could realistically use 35 gigabytes (i was using around 11) and not violate the terms of service. And I think the combination of offering 35 gigs of space and hiding that VERY important sentence deep down in the middle of paragrpah 10 of their 31 paragraph terms of service is a trap to get people to violate the TOS.

My only legal advice so far is to call my credit card company and have them cancel the payment. But I just don't think I want to get involved in that.
