Sydivingmovies.com has been shut down. The web host, with no warning, suspended my account. They consider the site to be a "dumpsite," which they say violates their terms of service. And that also means I can't get my money back. I'm paid up or a year. Edit: Well, looks like theres nothing I can do. I missed this in the terms and agreements: "Usage of allotted Resources. You agree that the use of the Plan(s) will not exceed the server resources (bandwidth, storage, e-mail usage, CPU) allotted to your Plan(s). If you use any resources that surpass the percentage or megabytes agreed upon, or if you exceed E-mail storage and attachment size limitations, Infinology may, in its sole discretion, apply additional charges, suspend the Plan's usage, or terminate this agreement. No shared hosting account is allowed to host scripts which consume more than 3% CPU and 7MB of memory per process. Infinology hosts production sites on production servers. Our servers are not to be used as a testing environment. Any website that causes downtime or heavy load on a server will be suspended without prior notification to you. Any site with traffic consisting more than 33% in file downloads (non HTML files) may be considered a WAREZ site and will be subject to immediate suspension without prior notice to you. In the event that Infinology elects to take corrective action, you will not be entitled compensation for any used or unused prepaid fees." In other words, skydivingmovies.com was a warez site and I didn't even know it. Most expensive mistake I've made in a while. Ugh. So that's that. It was nice while it lasted. pilotdave 0 #7 February 24, 2004 Naah, this was nothing automated. They didn't care what was on the site, only that it was using a crapload of their resources. I'm sure they checked to see what was on the site. In fact, when I purchased the hosting, they called me on the phone to confirm I had ordered it, and the guy, going only by the domain name, mentioned that streaming videos were not allowed. I don't know what other web hosts would charge for a site like I had, but I think the best deal I could get would be a dedicated server at the same host I was at. And for a dedicated server, there would be no way to do a short trial. Setup fees are hundreds of dollars, and I think the monthly fee goes through the roof if you don't buy a year at a time. (The hosting I had woulda been double the price if I payed month by month). The mistake I made was not doing a big test of the site while I could get a 30 day money back guarantee. I was just thinking this morning how smart I was to wait till the site was really finished before opening it up. But right up to last Saturday I could have gotten my money back... at least I think. I've written the company an email asking for more details on why I was shut down and explaining some things. The more I look at it, the more I think I not have been violating their terms of service. But I do know there are some hosts that will let you build a "dedicated box" ship it to them and they'll host it. Might cut some setup fees etc.. Just a thought. I don't quite see how any website with pictures on it wouldn't violate the terms of service. I don't see how anyone could realistically use 35 gigabytes (i was using around 11) and not violate the terms of service. And I think the combination of offering 35 gigs of space and hiding that VERY important sentence deep down in the middle of paragrpah 10 of their 31 paragraph terms of service is a trap to get people to violate the TOS. My only legal advice so far is to call my credit card company and have them cancel the payment. But I just don't think I want to get involved in that.
