Calif. Supreme Court Orders Halt to Gay Marriages

San Francisco is already ignoring the state law and the Governor. Why does the Supreme Court of California think they'll hold sway?

Yes, it adds another voice to the subject, but simply ordering the stoppage without ruling on the legallity of them is just silly.

I don't discount your point. However, it does show about the quality of the type of leadership in San Francisco. Mayor Brown is not so special that he can simply discount current state law. The Legislature in this state is liberal enough to make this legal. Mayor Brown is now saying that even the political process (a crummy as it is) isn't good enough. "I'll do what I want to do, when I want to do it."

I could not care less about who get married to whom, but I do care about reckless disregard taking action in this form. [:/]

I think it depends on the issue trying to be dealt with.

Although the Underground Railroad was illegal, I think we (as a whole) now hold the people that participated in it in very high regard.

Anyone else find this one confusing:

Massachusetts lawmakers gave preliminary approval to a constitutional amendment that would ban gay marriage but allow civil unions.

I've been trying really hard to figure this out too... You know, I have enough crap to worry about in my life without worrying about who's marrying who - especially people who are not even a part of my life! Why do people get so upset about gay marriage??? And why is our new governor (Arnie) wasting his time trying to halt the gay marriages when he's got so many other things he should be dealing with? (and I guess I should say the same about our President too). I just don't get it...

Here's the difference. "The Collateral Bar Rule."

Persons may violate a law and not face any penalty (other than legal fees, time lost, etc.) if a court finds the law unconstitutional.

But, even unconstitutional orders of a court must be followed. If the court orders you to stop doing something, and you do not, it is contempt. This is true even if the court order was not merited.

Ironically, if the marriages continue despite a court order, there will be some straneg bedfellows, no pun intended. It was Alabama Supreme Court Judge Roy Moore who violated a court order to remove the 10 Commandments. Perhaps the SF mayor oughtta give Judge Moore a call and ask for some pointers (again, no pun intended).

That would be funny. I'd love to interview Roy Moore and get his opinion on this!

I think Willie Brown was a crappy mayor, but I actually regret voting for Newsom's opponent. Newsom has the balls to do what is right... equal rights. The Underground Railroad is a great example!

Slavery and same-sex-marriage is hardly comparable. In fact, they aren't in the same league.
